The tribunal's findings have been published in the book The Gaza Tribunal, which compiles the evidence presented, alongside opening and closing essays and an afterword by renowned Irish novelist Sally Rooney.

GAZA: THE SUFFERING CONTINUES
Today in Gaza, most of the TV cameras are gone and media interest has declined. But, more than nine months after the announcement of a supposed “ceasefire”, the suffering of the Palestinian people continues.
Today, 92% of housing units in Gaza are damaged or destroyed, 70% of the entire population lacks adequate housing and is forced to live in makeshift shelters, 86% of agricultural water wells have been damaged, the vast majority of households report significant challenges in accessing safe and clean sanitation facilities and 90% of all energy infrastructure has been destroyed.
And what about the children? Today in Gaza, 91% of school-aged children do not have sustained access to in-person education, 93% of school buildings will require full reconstruction or major rehabilitation to be functional again and 70% of infants and young children under two years of age are experiencing moderate to severe food insecurity.
All of this is taking place after the horrific destruction that Netanyahu’s extremist government brought to Gaza over the last three years: more than 73,000 Palestinians killed and 173,000 wounded — mostly women, children and the elderly. In addition, virtually the entire infrastructure of Gaza was destroyed.
Israel now controls an estimated 70% of Gaza, well beyond what they agreed to, and has built dozens of military outposts inside Gaza since the “ceasefire” began. In the nine months since the “ceasefire” was announced, Israel has killed at least 1,150 Palestinians, including a family of six last week.
Now, as if to remove any doubt about their intentions, senior leaders of the Netanyahu government are moving to make the occupation permanent. Recently, a number of government ministers led thousands of settlers to the Gaza border demanding new illegal Jewish settlements be built there. National Security Minister Itamar Ben-Gvir stood up and said "Gaza is ours."
The shameful fact is that the United States is complicit in everything that is happening in Gaza. We have funneled tens of billions of dollars in military aid to an Israeli government that has consistently violated international law and whose leader is a war criminal.
The good news is that the American people are catching on. More and more Americans — Democrats, Republicans and independents — are demanding that we stop all military aid to Israel and use our considerable leverage to end the suffering of the Palestinian people.
Enough is enough! Congress must listen to the American people. NO MORE U.S. MILITARY AID TO ISRAEL.

الحرية ولماذا غاب الاستثناء العربي؟
لطالما راودني سؤال: كيف لمنطقة جغرافية شاسعة تمتد من موريتانيا إلى عُمان، رغم تنوعها العرقي وثقافاتها الفرعية وتفاوت ثرواتها، أن تفشل في إنتاج ولو نموذج صغير، إمارة بحجم موناكو مثلًا، تكون واحة للحرية من باب الاستثناء؟ أو بصيغة أخرى: لماذا غاب هذا الاستثناء؟ ولماذا تنافسنا على ما هو أدنى، لا على ما هو خير؟
إنه سؤال جاد، ليس الهدف منه القول إن هذا البلد أفضل من ذاك، ولا المقارنة بقصد الإدانة، بل محاولة فهم ظاهرة سياسية تستحق التأمل. فغياب نموذج عربي واحد يكون الإنسان فيه حرًا بصورة مستقرة يلفت النظر أكثر من أي مقارنة بين الدول. ويمكنك أن تقيس الحرية أحيانًا من طريقة حديث الناس؛ من قدرتهم على التعبير عن أنفسهم بجمل واضحة لا تختبئ خلف كلمة «لكن»، ولا خلف العبارات الملتبسة ولغة الخوف والإيحاء.
ولو نظرنا إلى بقية أقاليم العالم، لوجدنا أن الاستثناء يكاد يكون قاعدة. ففي أميركا اللاتينية ظهرت كوستاريكا نموذجًا مختلفًا وسط منطقة عرفت الانقلابات والحروب الأهلية. وفي أفريقيا برزت بوتسوانا مثالًا على الاستقرار المؤسسي والحكم الرشيد. وفي شرق آسيا تحولت كوريا الجنوبية وتايوان من السلطوية إلى الديمقراطية. وحتى أوروبا، التي عاشت قرونًا من الحروب، أنتجت دولًا صغيرة مثل سان مارينو وأندورا وليختنشتاين، أصبحت الحرية فيها جزءًا من هوية الدولة.
في المقابل، يبدو أن العالم العربي انشغل بشيء آخر. فبدلًا من التنافس على إنتاج أفضل نموذج سياسي، أصبح التنافس أحيانًا على إنتاج أفضل صورة للنموذج. ازدهار اقتصادي، عمران مدهش، مؤسسات إعلامية ضخمة، وحملات ترويج متقنة، لكن السؤال الذي يبقى خارج الصورة هو: ماذا عن حرية الإنسان؟ بل إن بعض المنصات الإعلامية تتقن نقد الآخرين أكثر مما تتقن نقد واقعها، وكأن وظيفة الإعلام أن يكون مرآة للخارج لا للداخل. المشكلة ليست في النجاح الاقتصادي، فهو إنجاز يستحق التقدير، بل في تحويله إلى بديل عن الحرية، أو إلى ستار يخفي غيابها.
التفسيرات التقليدية لا تبدو كافية. فالثقافة وحدها لا تفسر الظاهرة، لأن ملايين العرب يعيشون داخل ديمقراطيات راسخة ويتفاعلون معها بنجاح. والإسلام ليس تفسيرًا مقنعًا، لأن دولًا ذات أغلبية مسلمة خارج العالم العربي أنتجت تجارب أكثر انفتاحًا. والاستعمار لا يكفي أيضًا، لأن شعوبًا كثيرة خرجت من الاستعمار وبنت مؤسسات أكثر رسوخًا.
لعل التفسير الأقرب هو أن العالم العربي لم يكن مجرد مجموعة دول متجاورة، بل منظومة سياسية مترابطة، ينظر كل طرف فيها إلى نجاح تجربة حرة بوصفه حدثًا يتجاوز حدودها. فالدولة الحرة لا تبقى شأنًا محليًا، بل تتحول إلى مرجع يقارن الناس به أوضاعهم، وإلى سؤال ينتقل من مجتمع إلى آخر: إذا نجحوا، فلماذا لا ننجح نحن؟
ومن هنا يمكن إعادة قراءة ما جرى في مصر عام 2011. فالقضية لم تكن فقط تعثر انتقال سياسي في دولة كبيرة، بل احتمال ولادة أول نموذج ديمقراطي عربي في الدولة الأكثر تأثيرًا من حيث السكان والثقافة والإعلام. ولو نجحت تلك التجربة، لكان من الصعب حصر أثرها داخل الحدود المصرية. ولهذا يظل سؤال مشروع مطروحًا للنقاش: هل كان الإصرار، داخليًا وإقليميًا، على إغلاق نافذة الفرصة والقضاء على الديمقراطية الوليدة نابعًا فقط من صراع على السلطة، أم من الخوف أيضًا من نجاح النموذج نفسه؟ لا يمكن الجزم بدوافع جميع الفاعلين، لكن من الصعب تجاهل أن النموذج الناجح قد يكون أكثر تأثيرًا من أي خطاب سياسي، وأن الأفكار تعبر الحدود بسهولة تفوق عبور الجيوش.
لهذا أعتقد أن السؤال الحقيقي ليس: لماذا تأخرت الديمقراطية في العالم العربي؟ بل: لماذا غاب حتى الاستثناء؟ فالأمم تتقدم غالبًا عندما ينجح نموذج واحد في كسر المألوف، ثم يتحول إلى مصدر إلهام لجيرانه. أما حين يُمنع الاستثناء نفسه من الظهور، أو يُحاصَر قبل أن يكتمل، فإن المنطقة كلها تدخل في دائرة مغلقة، لا تتنافس فيها على بناء أفضل نموذج، بل على تسويق أفضل صورة. وهناك فرق هائل بين دولة تصبح نموذجًا لأن الناس يريدون تقليدها، ودولة تحاول إقناع الناس بأنها نموذج لأن آلة الدعاية تقول ذلك.
الدولة داخل الدولة المفهوم القديم مقابل الجديد
كيف نبدأ في تعريف مفهوم "الدولة داخل الدولة" بعيدا عن الرؤى القديمة ومستلهمين التاريخ من شركة الهند الشرقية حتى اليوم ليكون المفهوم مفيد تحليليا؟
البداية من تعريف السيادة نفسها. فالسيادة لا تعني احتكار السلاح فقط، بل احتكار الوظائف السيادية. وكل كيان ينازع الدولة في وظائفها، أو يفرض عليها إرادته، هو دولة داخل الدولة، سواء كان مليشيا، أو حزبًا، أو شركة، أو منصة رقمية.
يرتكب كثيرون خطأً نظريًا حين يحصرون مفهوم "الدولة داخل الدولة" في المليشيات المسلحة. هذا تعريف ينتمي إلى القرن العشرين. أما في علم السياسة، فالمعيار الحقيقي هو السيادة الوظيفية: أي كيان يستطيع أن ينازع الدولة في وظائفها الأساسية، أو يفرض عليها إرادته، يصبح دولة داخل الدولة، حتى لو لم يمتلك دبابة واحدة. شركة الهند الشرقية حكمت الهند باسم التجارة، لا باسم الجيش. واليوم قد تؤدي بعض الشركات العملاقة الدور نفسه عبر المال، والبيانات، والبنية التحتية، والقدرة على التأثير في التشريع وصنع القرار. السؤال لم يعد: من يحمل السلاح؟ بل: من يملك القدرة على جعل الدولة تغيّر سياساتها أو تعجز عن فرض إرادتها؟ عند هذه النقطة، تصبح الشركة دولة، ولو بقي اسمها «شركة».
