Democracy in Decline: Reflecting on Two Years of Present Government

Today, June 12, is slated as Democracy day. Most unfortunately, in our present state, our dear country Nigeria cannot be justifiably classified as a democratic country. The vital indicators of democracy are noticeably absent. Some do not even exist.

Democracy is said to be ‘a government of the people, by the people, and for the people,’ yet none of these three measures exist in our democracy today. Rules, regulations and requirements to participate in elections or be elected for are not followed, consequently, individuals who are to be disqualified ab-initio are now holding public offices.

As we mark June 12, a day symbolizing the struggle for true democracy in Nigeria, it is deeply troubling that under this present administration in a short span of two years, our nation has witnessed broad erosion of democratic principles. There has been a corresponding decline in security and the quality of life for millions of Nigerians. We have traversed from rigged elections to collapsing social services; from soaring poverty to rising corruption; and from a seemingly stable economy to a parlous economy.

It is most troubling that in its two years in office, the present government has brought the nation to the point where our leaders now celebrate and endorse failure, lies, and propaganda. The government today, rather than show genuine accountability and measurable progress, focuses on manipulating narratives, gaslighting the public, shifting blame and weaponizing governance. Meanwhile, Nigerians live in a worsening and worrisome insecurity, widespread corruption, hunger, and general despondence. There are no clear benchmarks for measuring tangible development, as we continue to witness the collapse of key indicators - like education, healthcare, and poverty alleviation- which are parameters for measuring national progress.

Simple comparisons of what has happened in the past two years, now relies on propaganda and misinformation to mask the mis governance.

Our country today can best be described as a nation declining fast in all its facets. The security of lives and property has worsened, and the rule of law is virtually non-existent. These are the hard-verifiable facts:

1. On May 29th, 2023, when this government was sworn into office, Nigeria’s Gross Domestic Product (GDP) stood at $364 billion. As of today, it has declined to $188 billion, a decline of almost fifty percent (50%).

2. Nigeria’s GDP per capita was $1,640 as of May 2023, but today it has dropped drastically to about $835, a devastating decline of about 50%.

3. Nigerians living in multi-dimensional poverty increased from 38.9% to 54% within this period, with about 129 million Nigerians now living below the poverty line. The World Bank reported recently, that 75% of Nigerians in the rural area now live in poverty as at 2025, and even more than previously recorded in the urban areas.

4. Our education sector has deteriorated significantly. Today, more than 18.3 million Nigerian children are out of school, the highest number in the world. The quality of education in Nigeria is also fast deteriorating. Many of our children are being taught sciences without any science lab and computer studies without any computers. Students are now writing WAEC and other national exams in darkness relying on candles. There are now even glitches in their exams.

5. Health services have worsened drastically. The National Primary Health Care Development Agency decried that less than 20% of over 30,000 Primary Healthcare Centers across the nation are fully functional.

I have even recently visited some Health Centers where delivery rooms were without toilets. The United Nation recently reported Nigeria as the world's worst country to give birth, with one death recorded every seven minutes.

This is the text of the remarks I would have delivered at today’s NASS joint session, as indicated in my letter of invitation. However, due to time constraints, the programme of events had to be abridged. Nonetheless, I still believe it is important to share my thoughts on this platform.

BRIEF REMARK BY FORMER SENATE PRESIDENT, DR. ABUBAKAR BUKOLA SARAKI, CON, ON THE TOPIC: “THE NATIONAL ASSEMBLY AND NIGERIA’S DEMOCRACY IN THE LAST 26 YEARS” AT THE JOINT SESSION OF THE NATIONAL ASSEMBLY ON DEMOCRACY DAY, THURSDAY, JUNE 12TH, 2025 HELD INSIDE THE HOUSE OF REPRESENTATIVES CHAMBERS, NATIONAL ASSEMBLY COMPLEX, ABUJA.

1. I have been given just three minutes to talk on the important topic of the impact of the National Assembly in the last 26 years of democracy in our dear country. Let me therefore quickly acknowledge the presence of President Bola Ahmed Tinubu, Vice President Kashim Shettima, Senate President Godswill Akpabio, Speaker Tajudeen Abbas, their deputies, other principal officers, other former presiding officers of the two chambers of the National Assembly here present, and members of the 10th National Assembly. Furthermore, I adopt the protocol already established by the previous speakers.

2. Ladies and gentlemen, permit me to quickly make five points before the time allotted to me expires. First, I congratulate all Nigerians at home and abroad on the 26th anniversary of democracy. This achievement is a result of the sacrifice and perseverance by all of us and as such we deserve a pat on the back for this.

3. Second, let me join all of us in remembering and celebrating our heroes and heroines of democracy who paid different types of prices and those who made various sacrifices to end military rule and return our country to democracy. Without their sacrifice, we will not be here today. From the known political leaders to the unsung and unknown protesters on the streets who lost their lives, limbs, and livelihoods during the fight against military rule. May Almighty God bless all their souls. As we praise those who helped us to achieve this democracy, we also need to commend those who have worked hard to sustain it.

4. Third, I want to commend President Tinubu for choosing to join the National Assembly here in this chamber to celebrate Democracy Day. This symbolic action speaks volumes. This is an acknowledgment of the fact that among the three arms of government, the one that best symbolizes, represents, and exemplifies democracy, is the parliament. Today, the Nigerian leadership did not gather in Aso Rock Villa, or the foyer of the Supreme Court, or the covered seats of Eagle Square to celebrate democracy. We are here in the Green Chamber of the National Assembly to celebrate representative government. Today’s gathering indicates clearly that the legislature is the bedrock of democracy.

“STATE OF EMERGENCY IN RIVERS: “SUSPENSION” OR OTHERWISE SUMMARY REMOVAL OF A DEMOCRATICALLY ELECTED GOVERNOR AND OTHER ELECTED OFFICIALS IS UNCONSTITUTIONAL”

The Nigerian Bar Association (NBA) @NigBarAssoc has taken due notice of the declaration of a state of emergency in Rivers State by President Bola Ahmed Tinubu, as contained in his address to the nation today, 18th March 2025. This declaration according to the President is due to the prevailing political tension in the state and due to the “vandalization of pipelines between yesterday and today:” This development has far-reaching constitutional and democratic implications, particularly in light of the provisions of Section 305 of the 1999 Constitution of the Federal Republic of Nigeria (as amended), which governs the procedure for the proclamation of a state of emergency and which the President purported to have relied upon.

Section 305 of the Constitution indeed vests the President with the power to declare a state of emergency, the Section stipulates strict conditions and procedural safeguards that must be followed to ensure that such extraordinary measures do not infringe on democratic governance and fundamental human rights.

The NBA is gravely concerned about the purported suspension by the President of the Governor of Rivers State, the Deputy Governor, and the Members of the Rivers State House of Assembly for six months.
The 1999 Constitution does not grant the President the power to remove an elected governor, deputy governor, or members of a state’s legislature under the guise of a state of emergency. Rather, the Constitution provides clear procedures for the removal of a governor and deputy governor as per Section 188. Similarly, the removal of members of the House of Assembly and dissolution of parliament is governed by constitutional provisions and electoral laws, none of which appear to have been adhered to in the present circumstances.

A declaration of emergency does not automatically dissolve or suspend elected state governments. The Constitution does not empower the President to unilaterally remove or replace elected officials—such actions amount to an unconstitutional usurpation of power and a fundamental breach of Nigeria’s federal structure.

The NBA firmly asserts that the situation in Rivers State, though politically tense, does not meet the constitutional threshold for the removal of elected officials.
For a state of emergency to be declared, Section 305(3) of the Constitution outlines specific conditions, including:
1.War or external aggression against Nigeria.
2.Imminent danger of invasion or war
3.A breakdown of public order and safety to such an extent that ordinary legal measures are insufficient.
4.A clear danger to Nigeria’s existence.
5.Occurrence of any disaster or natural calamity affecting a state or a part of it.
6.Such other public danger that constitutes a threat to the Federation.
The NBA questions whether the political crisis in Rivers State has reached the level of a complete breakdown of law and order warranting the removal of the Governor and his administration. Political disagreements, legislative conflicts, or executive-legislative tensions do not constitute a justification for emergency rule. Such conflicts should be resolved through legal and constitutional mechanisms, including the judiciary, rather than executive fiat.

The purported removal of Governor Fubara, his deputy, and members of the Rivers State House of Assembly is therefore unconstitutional, unlawful, and a dangerous affront to our nation’s democracy.
Furthermore, subsection (2) of Section 305 provides that:
“A Proclamation issued by the President under this section shall cease to have effect—
(a) if it is not approved by a resolution of the National Assembly within two days when the National Assembly is in session; or
(b) if the National Assembly is not in session, within ten days after it reconvenes.”

These provisions provide that a state of emergency declared by the President does not assume automatic validity. It requires legislative ratification within a defined timeframe to remain in effect. The NBA, therefore, emphasizes that unless the National Assembly duly approves the proclamation, the declaration of a state of emergency in Rivers State remains constitutionally inchoate and ineffective.

In light of the foregoing, the Nigerian Bar Association:
•Affirms that the President does not have the constitutional power to remove an elected governor under a state of emergency. Any such action is an unconstitutional encroachment on democratic governance and the autonomy of state governments.
•Calls on the National Assembly to reject any unconstitutional attempt to ratify the removal of the Rivers State Governor and other elected officials. The approval of a state of emergency must be based on strict constitutional grounds, not political expediency.
•Warns that suspending elected officials under emergency rule sets a dangerous precedent that undermines democracy and could be misused to unseat elected governments in the future.
•Demands that all actions taken in Rivers State strictly conform to constitutional provisions and Nigeria’s democratic norms.
•Encourages all stakeholders, including the judiciary, civil society, and the international community, to closely monitor the situation in Rivers State to prevent unconstitutional governance and abuse of power.

The NBA remains committed to upholding the Constitution, defending democratic governance, and ensuring that the rule of law prevails in Nigeria. A state of emergency is an extraordinary measure that must be invoked strictly within constitutional limits. The removal of elected officials under the pretext of emergency rule is unconstitutional and unacceptable.

We call on all relevant authorities to act in accordance with the law and the best interest of the country. Nigeria’s democracy must be protected at all costs, and the Constitution must be upheld as the supreme legal authority in all circumstances.
