Innocent Americans are being convicted by a process that counts only the evidence supporting the government's theory. The documents that contradict it — the ones that would end the case — get set aside, not suppressed. They arrive, they're read, and they change nothing, because by then the theory is already settled.

The Supreme Court decided in 1935 what the job actually is. The government's interest "is not that it shall win a case, but that justice shall be done." Berger v. United States.

The Department stopped measuring itself against that standard a long time ago. Nobody is promoted for declining to charge.

It is never too late to do the right thing.

Today one of our own walks through those doors and begins serving their sentence.

Is a level playing field something we can realistically look forward to? I lost my job and was left without the means to provide for my child - result of an unjust prosecution. No prison, but a felon for life. Is there any hope for people like the #43Americans? Will we ever be acknowledged?

That line is the story. There's a review team, and "tracked" is apparently a status a petition either has or doesn't.

Worth asking what gets one tracked. A group of 43 people with federal cases, no lawyers or lobbyists between them. Several have their full records documented, sourced to the docket. One of us reported to federal prison yesterday. Two more report on September 10.
