P&H HC ruled: An Army recruit joined the Indian Army as a Sweeper. Boarded out with 30% disability (broad-banded to 50% under Rule 7.2) was wrongly denied a job. Court quashed rejection & directed Class-IV appointment within 2 months. (https://t.co/YmDWduiB9W)

But boarded-out officer cadets get no such benefits, no pension, no employment support (at same pay band), excluded from Ex-servicemen (re-employment in central civil services posts) 1979.

Broad-Banding for Cadets: Law Settled, Govt in Denial

Delhi HC in Puneet Gupta v. UOI (2016) held that boarded-out disabled Cadets are entitled to broad-banding of disability at par with Officers.
Review dismissed in 2018. Judgment attained finality.
Yet, MoD continues to deny, inserting fresh exclusions in 2023 Rules—contrary to HC, SC & AFT pronouncements.

This is not about charity. It is about equality, dignity & rightful entitlements of young men & women who once wore the uniform.

The armed forces imbibed in all of us that we don’t leave our fallen behind. It is only because of those who are alien to the concept of soldiering can come up with such arbitrary and discriminatory policies to disentitle medically boarded out officer cadets their entitlement to disability pension and allied benefits in parity with others. High time for the system to undo this historical wrong which has been going on for decades.

Sqn Ldr Rajkumar Herojit Singh (commissioned in 2013). Flt Lt Yogesh Yadav (commissioned in 2021)stand testament that that disability is no barrier to service. Denying other cadets the same chance violates #Article14 & the spirit of 🇮🇳 Forces. Equality in uniform, now.
