DPP faulted for protecting suspects in massive Ksh706M tax scam case

A major fraud case involving over Ksh706 million will now proceed to full trial after the High Court refused to end it.

The case involves Multiple Hauliers (EA) Ltd, a well-known logistics company accused of tax evasion and making false declarations to the Kenya Revenue Authority.

The court’s decision follows a failed attempt by the Director of Public Prosecutions to drop the charges, citing lack of enough evidence.

Justice Nixon Sifuna dismissed the DPP’s request, calling it weak and filed too late. He pointed out that the case had already gone on for six years, and it had reached a stage where justice demanded that it be heard to the end.

According to the judge, stopping it now would not only be unfair but would also harm public trust in the justice system.

The court stressed that high-value fraud cases should not be withdrawn without strong legal reasons.

Allowing such a withdrawal, the judge warned, would send the wrong message and encourage impunity.

He added that accountability must be upheld, especially when large sums of money and public interest are involved.

With the case still active in the Anti-Corruption and Economic Crimes Division, the prosecution is now expected to continue presenting witnesses and evidence.

The accused will also get a chance to respond and give their side of the story.

This ruling serves as a reminder that no matter how long a case has taken or who is involved, the law must take its course.

It also highlights the need for seriousness and transparency in handling financial crimes.

The court’s stand has strengthened the call for justice and fairness in Kenya’s fight against corruption.
