Let me share this practice experience with us.
In one of the judgments I got in April 2026, I experienced an unnecessary interruption (subtle mockery) from a lawyer during the trial.
The Defendant was standing trial for illegal possession of A CARTRIDGE, which, according to our law, is a firearm.
During the trial, the IPO sought to tender TWO CARTRIDGES against what was captured in the charge.
When I observed the above, I did not bother to oppose the tendering of the said items. They were tendered, admitted, and marked accordingly.
After the items were admitted and marked, a senior colleague beside me said, "Who taught you practice? Why did you allow them to tender the cartridges without objecting to it? You have made a terrible mistake."
Knowing that his words would distract me, I stared at him for some seconds and continued with the trial.
When the judgment was delivered on April 22, 2026, the Court agreed with me, among other issues raised, that the exhibit tendered was at variance with what was contained in the charge.
If you are a (young) lawyer, always master your file. The file is more important than the cases because the cases and laws will be applied to the facts contained in your file.
When you've mastered your file, do not allow (side) interruptions and mockery from colleagues to distract you. Only listen to colleagues who genuinely wish to guide and assist you.
Be audacious in utilising your strategy, and the desired results will come.

The challenge with this impeachment trial is that either way @rigathi has already won:
1. If they UPHOLD the impeachment, Gachagua will say look i told you Ruto is targeting mrima. Just same way he paid senate, he has paid the bench, (In any event, some aspects of that bench are known to be reachable). He will use the decision as campaign sympathy card.
2. If they OVERTURN the impeachment…same thing, he will say look i told you Ruto is targeting mrima, his paid for senate impeachment has been overturn. He will use the decision to campaign,
So either way he is in a very strong position, he is just waiting for the decision to hit the campaign trail with.
For the bench, its only way out is to do pure law and justice.
Summary: government will lose either way, Gachagua will win either way, the bench will be judged by its decision.
The finance bill 2026 will affect us negatively as follows;
1. Rental income tax has been raised from 7.5% to 10%.(Brace yourself for increased rent)
2. Mitumba traders, brace yourselves.
Import a bale at Ksh1M → Pay Ksh50K tax upfront.
3. They’re removing VAT exemptions on mobile money and digital payments.This will increase the cost of sending money.
4. KRA can now decide 60% of your company’s retained earnings are “dividends” and tax you anyway.
5. An introduction 25% excise duty on phones.
6. Banks won’t absorb new compliance costs. Let’s be serious.

7. They’ve moved tax return deadlines from June to APRIL.
Tough times ahead.
Justice Eric Ogolla, Principal Judge, High Court, invited me to the Judges' conference in Mombasa, 6-10 June. He told me to pick a topic of my choice. I prepared a 20-page paper titled: "CJ KOOME, GRAND CORRUPTION AND JUDICIAL IMPUNITY: THE TOXIC TRINITY BLEEDING THE KENYAN JUDICIARY TO DEATH". The thesis: (a) The judiciary poses an existential threat and is the biggest national security threat facing Kenya. (b) That CJ Koome is clueless and incompetent and must resign immediately for she is "Engethua Ndogoria itingekinyera Nyeki" (a limping leader sheep cannot lead the rest of the flock to greener pasture". (c) we must have a 5 year cycle for lifestyle audit for judges (d) JSC must revamp its process of removing judges and be more transparent (e) Cj Koome and the JSC have established a policy of total immunity for corrupt judges no matter the evidence (f) Corruption is now a normal and accepted enterprise for judges and magistrates...As i was preparing to fly to Mombasa i received a call from the judiciary informing me that my invitation to the conference was withdrawn "on orders from above"....🤣🤣🤣🤣
@aomenya I am disappointed in this post. You seemed reasonable having listened to you ramble about urban planning on several Tv stations...This is a low for anyone let alone a prof.
