you're conflating enforcement priorities with legal status. Prioritizing violent offenders has never meant that everyone else who is unlawfully present is suddenly in compliance with immigration law. immigration violations don't cease to exist simply because someone isn't a violent criminal. likewise, no one is "criminalizing" someone after the fact. immigration law already establishes the legal consequences for unlawful entry, unlawful presence, visa overstays, and other violations. enforcement doesn't create the violation it responds to an existing one. as for asylum or adjustment of status, each case depends on its legal posture. simply saying someone is "in the process" doesn't automatically make their presence lawful or exempt them from enforcement. those determinations depend on the facts of the individual case and the applicable immigration laws.

whether someone is on their way to work is legally irrelevant to the underlying issue. a person may be authorized to work yet still be unlawfully present for example, by overstaying a visa or otherwise violating immigration law. the question isn't what they were doing at the time of the encounter; it's whether they were lawfully entitled to remain in the country. immigration laws exist for a reason, and intentionally circumventing lawful immigration enforcement doesn't change the legal status of the individual.
it also doesn't take much to address one's immigration status before enforcement becomes necessary. if someone knows they are violating immigration law, waiting until an encounter with ICE to characterize enforcement as an "attack" doesn't change the underlying legal issue or the fact that their immigration status should have been resolved earlier. @SB_SpaceCowboy

it's about illegal immigration and the consequences that come with it. criminal organizations exploit unsecured borders for drug trafficking, human trafficking, and other forms of organized crime. those problems don't stop at state lines, they affect native communities, our lands, and every other community in this country. reasonable people can debate how immigration should be handled
