@0xMakesy No the fact that SI wasn’t in an insolvency or fraud/criminal situation that caused it’s failure. I was fully expecting us to find out that SI had done something obvious that would’ve justified FHLB accelerating. I guess it’s probably better if I said the LACK of evidence instead

for UST, the SEC also provides an alternative, non-Howey-based argument, that UST are "rights to subscribe" to a security (LUNA) and thus are themselves securities--again, this is an "enumerated security" type of argument (like the one for wLUNA) that does not rely on the Howey test
