I love how RCCG members are standing up for Adeboye. While not a fan of the man, he is not the reason for our problems in Nigeria. Whether he speaks up or not is immaterial…what have we done for ourselves as a people?

Two things are fundamentally wrong here:

1. Imposing a term requiring a civil servant as a surety. The Court of Appeal and Supreme Court, have increasingly ruled that making civil or public servants mandatory as sureties for criminal defendants is an error of law and constitutional aberration. While lower courts still frequently impose this as a bail condition, appellate courts have repeatedly faulted and removed it.

2. The essence of bail is to promote fair hearing and not make it impossible for the defendant to fulfil. It’s not a criminal conviction and it is a discretion that must not be abused or taken too far. Judges of lower court abusing their discretion on bail requires serious intervention of the National Judicial Council. Serious sanctions such as suspension, removal and demotion need to be imposed on such judges.
