1. Passing off = one must prove that another party’s creation is a confusingly similar product which is causing confusion in the market place.
2. Leaning on = when one party leans on the reputation and/goodwill of another to sell their products.
@Tay_Dlamini @RealLifeGold @ladyzeem We wouldn’t use IP infringement as a defense for this matter. We would claim unlawful completion because the fact that you don’t have IP protection doesn’t mean your competitors can conduct business in an unfair manner.
