I am issuing this public statement to clarify critical facts surrounding my case, Harris v. Department of Transportation, which have been misrepresented or omitted in public summaries found on platforms like Justia and other legal databases.
Contrary to what has been widely reported or indexed:
The Department of Justice (DOJ) removed the case out of time. The Assistant U.S. Attorney (AUSA) failed to file the notice of removal within the proper statutory deadline, a procedural failure that undermines the jurisdictional basis for federal removal.
The AUSA in the case was caught making false representations to the court about material facts. This misconduct is not mentioned in publicly available summaries, but it is documented in official filings.
The DOJ Office of Inspector General (OIG) referred the AUSA’s conduct to other DOJ components for further investigation—an extraordinary step that confirms the seriousness of the violations.
Despite the severity of these facts, they are not reflected in public-facing summaries, which gives the misleading impression that the case was meritless or fairly dismissed. The omissions obscure the government's own procedural violations and misconduct.
I am currently pursuing rehearing and corrective relief, based on newly discovered evidence and the DOJ's failure to uphold its own ethical and legal standards as required under Justice Manual § 4-1.410.
