Law Commission of India recommends changes to #sedition law that will effectively make it more draconian.

Asks govt to add “tendency to incite violence or cause public disorder” to the section, where “tendency” would mean “mere inclination to incite violence/public disorder” and specifically recommends no proof of actual violence to be produced.

The commission also recommends increasing imprisonment from 3 years to 7 years for the offence.

How does one decide who has what “tendency” and “inclination” to incite violence? Such vagueness in law, deliberately retained by the state and courts, aids its misuse.

Two steps back for civil rights if this recommendation by LCI headed by ex-Justice Ritu Raj Awasthi is to be accepted by the government.
