If the plod are relying on the Aviation and Maritime Security Act 1990 to charge Danny Tommo for slashing the illegal migrant’s dinghy (S.11: damage a ship so as to endanger its safety) they will be relying on the Act’s definition of a “ship” (S.17) which includes any “other floating craft”.
In that case they could be in serious trouble. The definition goes on to include the provision that a craft is no longer considered a “ship” if it has been “withdrawn from navigation”.
There is no statutory definition of navigation. However, it is the case that the dinghy Tommo damaged had been abandoned at sea, and since the authorities consider these dinghies are unseaworthy and unfit for purpose, it is arguable that they have no intrinsic value.
Under the circumstances, under both international maritime law principles and the framework of the Aviation and Maritime Security Act 1990, such a vessel could - and likely would - be considered “"withdrawn from navigation”.
Thus, the dinghy was no longer a “ship” when Tommo slashed it, so he cannot be found guilty of an offence under the Aviation and Maritime Security Act 1990.
