Let’s talk about MA63 vs PDA 1974 — two important documents in Malaysia’s legal landscape — and why Petronas’ power over oil in Sabah & Sarawak isn’t as absolute as many think.

These Malayans want Sarawak to just follow whatever Malaya says, like back in Taib’s days. Funny though they used to hate on Taib for being useless and corrupt, but now they’re acting like they want another Taib in charge.
I’m both Sarawak and Petronas believers, and I believe Petronas should not do what it is doing now in Sarawak due to legal restrictions.
Sarawak, through PETROS, has a solid legal foundation to assert control over its O&G resources. This foundation is backed by the Malaysia Agreement 1963, OMO 1958, and the Federal Constitution. The Petroleum Development Act 1974 lacks legitimacy in Sarawak without constitutional amendment or state consent. Hence, PETROS’ issuance of a legal notice to Petronas Carigali for operating without a licence is well-founded in law and reflects Sarawak’s push to reclaim its rights under the Malaysian federation.
PDA 1974 gives Petronas exclusive ownership and control of Malaysia’s petroleum resources. The act was tabled after the 1969 constitutional crisis during Emergency Rule. This raises legitimacy questions about its application to East Malaysia. Land and natural resources fall under the State List (List II, Ninth Schedule), not the Federal List. The Constitution supports Sarawak’s claim that its own laws govern resource use within its borders—especially since no constitutional amendment transferred this power post-MA63.
I do hope our current government leadership could resolve this matter urgently, we don’t want Petronas do illegal activities in Sarawak.
It’s not about without Petronas, there is “No Malaysia”. It’s absurd, childish, egregious to say Petronas has do the right thing in Sarawak, as economic engine for Malaysia, Petronas should allow Sarawak to exercise its own rights and power to its land and resources (MA63 & OMO58). Sarawak Petros is for Sarawak, Petronas is for Malaysia. Why this thing is so difficult to understand?
Understand again the law, for PDA 1974 to apply constitutionally to Sarawak’s resources, a constitutional amendment would be required to shift power from State to Federal jurisdiction. PDA 1974 is a Federal Act — Passed without State Consent
1) No such amendment occurred with Sarawak’s consent.
2) As a result, OMO 1958 remains valid law, and Petronas operating without state licences could be construed as illegal.

Malaysia’s federal system is messed up because of the same colonial flaws by the UK.
Just like how UK made England without its own parliament while Scotland, Wales, and Northern Ireland do.
Malaya doesn’t have it's own parliament, but Sabah, Singapore and Sarawak do.

Korang dh 50 tahun monetize sumber dr SS. Apa salah nya ambik blik hak2 kami. Drpd korang bersatu utk bash Sarawak cuba korang bersatu utk push Petronas buat carigali di semenanjung. Kata ada byk reserve di perairan Kedah Penang Perak
