Did MGR not file corruption cases against DMK?

1971, DMK won the elections.Soon after retaining power, the party witnessed a major split.Caused by MGR.

While he the party’s MLA and treasurer, he raised questions against DMK functionaries and ministers of the State.Following this, he was expelled from the party .

On October 17, 1972, he founded a new political party ADMK.Shortly after that .MGR submitted a petition containing allegations of corruption against the ruling DMK to Governor, urging him to constitute an inquiry commission over his allegations and to dissolve the State government.

Same year, he along with veteran Communist Party of India leader M. Kalyanasundaram and others, submitted multiple memoranda to the President containing 28 allegations of corruption against CM M. Karunanidhi and several DMK ministers.

A oneman commission under SC judge Ranjit Singh Sarkaria was formed to investigate the allegations. In the first part of the fourvolume report, the Sarkaria Commission which investigated seven allegations held that six had been proved, wholly or in part.

In January 1976, the DMK government was dismissed.

The Sarkaria Commission was appointed during President’s Rule. MGR became Chief Minister in June 1977. After his government took office, investigations and prosecutions arising from the Sarkaria findings continued under the MGR administration. A later court record specifically notes that investigations in the matter ran from 1977 to 1980.

One of these corruption proceedings gave rise to the Supreme Court case M. Karunanidhi v. Union of India (1979). That case concerned a wheat procurement scam from Punjab; it is a separate matter.

The Sarkaria Commission alone found the following

Approximately ₹5.3 lakh in bribes were paid to Chief Minister M. Karunanidhi and Agriculture Minister Dharmalingam for an aerial pesticide spray contract.

Dharmalingam, who did not pay income tax when he joined the DMK government, acquired land, jewellery worth ₹3.8 lakh, and a stake in a textbook publishing firm within a few years.

Industries Minister Madhavan misused an industrial loan granted to a party MLA.

The tenancy law was amended with an ulterior motive to benefit a particular individual.

In recommending a factory licence to a film producer, Karunanidhi violated “prescribed procedures and established rules.”

A murder case investigation was conducted in a “highly improper, partisan and perfunctory manner” to protect three friends of Dharmalingam.

Karunanidhi misused his official position to favour Sathyanarayana Brothers in the Veeranam project contract.

On January 31, 1976, the DMK government was dismissed. The Sarkaria Commission functioned during President’s Rule.

Facing electoral setbacks, the Indira Gandhi government announced that legal action would be taken against Karunanidhi and his colleagues.

It appears that Sarkaria described the ousted Chief Minister and his close associates as pioneers of “scientific corruption.” Jayalalithaa used this phrase in the 2011 Assembly election campaign.

Due to the electoral defeat of the Emergency regime, the urgency of the inquiry, and the public perception that this was political vendetta, the corruption allegations against DMK and its leader were effectively set aside.

In particular, as R.S. Bharathi stated, the DMK’s electoral alliance support was needed by Indira Gandhi, and therefore action against DMK was dropped.

Furthermore, as Karunanidhi himself stated in the Tamil Nadu Assembly in 1997, during MGR’s tenure as Chief Minister, two attempts were made in 1977,79 to initiate a case against him based on the Commission report. However, Karunanidhi stated that Tamil Nadu’s Advocate General, V. P. Raman, advised that there was insufficient evidence to initiate criminal proceedings.

Raman, who was appointed Advocate General by MGR, was a supporter of the Justice Party and a friend of Karunanidhi. His position on the matter led to a rift between him and MGR.
