The most important part of this ruling:
“XRP, as a digital token, is not in and of itself a “contract, transaction[,] or scheme” that embodies the Howey requirements of an investment contract.”
This is a now a matter of law (not up for trial.)
Trying something new – some thoughts from me on the events (specifically the release of the Hinman documents) of this week. For me, this has all had a personal bent to it - and felt like it warranted some personal comments.
The Hinman emails show that the @SECGov itself is totally confused on how to regulate crypto. It is incredibly dishonest for @GaryGensler to claim that the rules are clear when the rule makers themselves don't even agree on them. But it is downright evil for the SEC to bring lawsuits and try to destroy crypto companies under the false premise that the rules are clear when they know they are not.
1/ It’s been 5 years since Bill Hinman gave his infamous speech – and through the SEC’s lawsuit against @Ripple (and 7 court orders), we can finally share what happened behind the scenes through the now public emails / drafts of the speech.
You Sir, are a bad faith regulator. Crypto investors needed you regarding Celsius and FTX. Instead, you met with Crypto’s biggest fraudster - @SBF_FTX - simply because he bought access to you and the SEC through political donations. While meeting multiple times with the Bernie Madoff of Crypto, you attacked American companies like @LBRYcom@Ripple@dragonchain and many more, all non-fraud cases. The American public needs protection for sure - from you.
To the Esteemed Chairman @GaryGensler of the Securities and Exchange Commission,
It is with great humility and a sense of honor that I, as a representative of the venerable House of Ripple, do hereby address you in the spirit of diplomacy and the pursuit of amicable resolution, reminiscent of the great Napoleon Bonaparte, who once said, "The battlefield is a scene of constant chaos. The winner will be the one who controls that chaos, both his own and the enemy's."
Whereas the complexities of our respective positions have brought us to this battlefield of legal and financial strife, we recognize the import of reaching a judicious settlement, one that fosters a prosperous future for all parties.
Thus, I present to you the following terms of settlement:
1The House of Ripple shall consent to pay a sum deemed equitable by the distinguished SEC, to be allocated toward the furtherance of investor protection and education.
2In the spirit of cooperation, the House of Ripple shall undertake to provide comprehensive and transparent disclosures, as prescribed by the wise counsel of the SEC, to ensure the utmost confidence and trust of the investing public.
3Ripple shall collaborate with the SEC in establishing a framework of compliance and oversight, ensuring adherence to the highest standards of regulatory probity, and fostering an environment of growth and stability within the cryptocurrency realm.
4The Securities and Exchange Commission, in turn, shall acknowledge the earnest efforts of the House of Ripple in addressing past discrepancies and shall permit Ripple to continue its operations, unfettered by the weight of historical transgressions.
5Both parties shall commit to the cessation of hostilities and pledge to engage in future dialogue with open hearts and minds, guided by the principles of fairness, integrity, and mutual respect.

Therefore, let us conquer our animosities and unite in the pursuit of a future that benefits not only the House of Ripple and the SEC but also the vast empire of the financial world.

@KraZeMike83 Agreed.. this frustrates me because new/naive investors feel good about “more tokens” rather than the % increase and REAL value of their investment. When memes fail it affects the entire ecosystem. Gems like $IGG could bridge that gap if listed appropriately, just my 2 Sats 😉
