The Surendra Koli Supreme Court verdict reveals the unsettling & disturbing reality of our Criminal (In)Justice System.
It is a chilling testament to how horribly the system fails the victims (and others) in a criminal trial & effectively gives up the claim to being Criminal Justice System.
The convictions have been set-aside primarily the following grounds:
1. The so-called judicial confessions being totally unworthy. The Accused was shown to be in uninterrupted 60 days police custody/remand before they were recorded, taking away any semblance of voluntariness & trustworthiness.
2. The IO was right outside the room when the statement was recorded. The statement can't be free and fair in such circumstances.
3. Statement itself mentioned torture and tutoring, totally demolishing the confession. (It is striking why no inquiry was done in that aspect then and there by the Magistrate recording the so-called confession!).
4. A perfunctory few-minutes legal aid interview is hardly meaningful legal representation.
5. Alleged discoveries (at the behest of the accused) were totally botched-up. No clear statement showing exclusive knowledge & recovery.
6. Some papers said it was a 'joint discovery' by both accused taking away the element of exclusive knowledge of the accused which is the acid test for S.27 IEA.
7. Recoveries shown from a place which wasn't in accused's exclusive possession and control.
8. Also, police was aware of the existence of bodily remains even before the discovery at the behest of the accused.
9. The alleged weapons weren't linked and proved to be causes of injury and operated by the accused.
10. No worthy biological evidence to link the accused. Every canon of proper forensic investigation violated.
These are just some of the damning aspects of this investigation and trial.
A trial that has failed, more than anyone else, the Victims and their families.
In addition to the order of setting-aside, it would have been good to see some serious evaluation of the responsibilities of the stakeholders who failed, and tangibly and visibly, fixing serious accountability.
Because until we do that, this is going to happen AGAIN.
