Can you believe this? The apathy of the Delhi High Court on display here is baffling! This is the Delhi Riots larger conspiracy case. Nine Muslims have been incarcerated on flimsiest of flimsy charges under the UAPA for MORE THAN four years. All that they ask for is bail. Their bail pleas were listed 34 to 60 times (as of December 2023), and despite reserving judgment for more than six months in some of these cases, the first two judges failed to deliver their verdict. One of the judges was later transferred (Justice Siddharth Mridul). The case kept hanging and had to be heard, all over again, by a fresh Bench. From January 2024, a new Bench started hearing the bail pleas. A couple of them were rejected. One of the rejected cases went to the Supreme Court and was listed before Justice Bela Trivedi, who also rejected the bail. The remaining accused continued their arguments before the Delhi HC, with some even finishing them. Despite this, all cases continued to be listed together and even those cases where arguments were completed, a judgment was not delivered. Now, the Chief Justice of the High Court has changed the roster of the judges, and YET AGAIN, a new Bench has to hear the arguments ALL. OVER. AGAIN. To add a cherry on top, one of these judges has now recused. Now, another new judge has to be nominated to hear these bail pleas. Meanwhile, all the accused continue to remain in jail. Their lives, devastated. Their businesses, devastated. Their families' lives, devastated. Their health, both mental and physical, gone. All because certain Lordships and Ladyships failed to ensure bail pleas are expeditiously heard. While the Chief Justice of India, D Y Chandrachud, can go on eloquently lecturing about personal liberty and expeditious bail hearings, what did he do when one of these accused challenged his bail rejection before the Supreme Court? He marked it to Justice Bela Trivedi. Out of all the 12 Benches that could hear criminal cases, Bela Trivedi's bench. Do you still think there is NO political pressure here? SHAM and SHAME.
