The Constitution is on trial, and so is every shilling in PUBLIC DEBT incurred since 1963. The High Court has agreed that the issues raised in our Odious Debt Petition (E216 of 2025) are weighty and worthy of empanelment consideration by the Chief Justice.
In our replying affidavit, led by the 4th Petitioner, we firmly opposed the Attorney General’s application to strike out the petition and responded decisively to the National Assembly’s affidavit.
We argue that the AG’s application is frivolous, unconstitutional, and a blatant attempt to sabotage public interest litigation. Instead of addressing our evidence showing 61 years of unaccounted borrowing, they’re trying to silence it procedurally.
The Constitution (Article 229(4)(g)) is crystal clear: Each year, public debt must be audited and reported within six months after a financial year ends.
This hasn’t happened since 2010. You cannot now retroactively claim you’re auditing from 1963 to avoid facing this case.
Between 2014 to 2023, the Office of the Auditor-General received over KES 42 billion to perform its mandate. Yet it has failed to lawfully audit our public debt or hold a single official accountable. That’s exactly what we’re challenging.
We are confronting a KES 6.95 trillion odious debt trap, and we’re naming the perpetrators of this economic crime committed against our Republic.
Given the magnitude, complexity, and constitutional weight of this petition, we’ve asked the Hon. Chief Justice to empanel a five or seven judge bench to hear this case.
We specifically urge the Chief Justice to assign a Super Bench, excluding the original 2015 petition bench, to determine the matter on merit. We cannot allow an entire generation’s future to be buried in shadows of impunity and silence.
This is Kenya’s moment to choose constitutionalism over convenience, truth over technicalities, and accountability over apathy.
And to the people of Kenya: do not lose hope. This petition is not just about the past. It’s about reclaiming our future. We are fighting to dismantle debt regimes that have stolen our taxes, mortgaged dreams, and betrayed our children.
A new Kenya is possible. One where every shilling is accounted for, every official is answerable, and the Constitution is not a suggestion but the supreme command of the people.
We will not stop. We will not be silenced. We will win.
