The solution with Mombasa road was to construct a normal 8-lane dual carriageway with smooth interchanges rather than roundabouts and blunt junctions. The Expressway is a redundant idea. We just needed a simple, bigger, better road.

There is no law in Kenya that permits hazardous loud music in public transport. None.
The supreme law, the Constitution of Kenya, is explicit:
Article 29 protects every person from any form of cruel, inhuman or degrading treatment. Subjecting commuters to extreme, involuntary noise in a confined public service vehicle can meet that threshold.
Article 42 guarantees every person the right to a clean and healthy environment. Noise pollution is environmental pollution. It is not a matter of taste. It is a legal issue.
Article 43 guarantees the right to the highest attainable standard of health. Prolonged exposure to excessive decibel levels causes hearing loss, hypertension, stress disorders and cognitive impairment.
Article 46 protects consumer rights, including the right to services of reasonable quality and to information. A commuter has not contracted for auditory assault.
Statutorily, the Environmental Management and Co-ordination Act, through the Noise and Excessive Vibration Pollution Control Regulations, 2009, classifies excessive noise as pollution and sets enforceable standards.
Regulation 4 prohibits making or causing loud, unreasonable, unnecessary or unusual noise that annoys, disturbs or endangers the comfort, repose, health or safety of others. That applies to public service vehicles.
Enforcement agencies are not helpless. The National Environment Management Authority @NemaKenya, has authority to measure, regulate and prosecute noise pollution offences. The National Transport and Safety Authority regulates public service vehicles and their compliance with safety standards.
The National Police Service @NPSOfficial_KE, has powers under EMCA and the National Police Service Act to enforce the law and maintain public order.
Failure to act is not a gap in the law. It is an abdication of statutory duty. This is not about music. It is about rights.
No Kenyan forfeits constitutional protections upon boarding a matatu. The law already provides the tools. What remains is enforcement.
