Mr @MaleMabiriziHKK has applied to have Her Worship Winnie Nankya Jatiko, wife to Assistant DPP, Thomas Jatiko to recuse herself from his case. He also insists on the presence of the press and public in his trial.
He says Her Worship Nankya can’t possibly be impartial because he has 2 criminal matters against her; one of which is Criminal Case 263 of 2026 where he’s privately prosecuting her and Her Worship Ritah Kidasa Neumbe for their handling of criminal case number 218 of 2026 in which he sought to prosecute Mr Richard Birivumbuka and others.
He claims that Her Worship Nankya and Her Worship Neumbe connived to dismiss his case against Mr Birivumbuka without a hearing, which he says is clear derogation of his non-derogable right to a fair hearing, contrary to Section 11 of the Human Rights Enforcement Act, 2019.
This is not the first time Mr Mabirizi has sought the recusal of Her Worship Nankya.
You might recall that a few weeks back when then presiding Magistrate Neumbe was absent, Mr Mabirizi appeared before Her Lordship Nankya; whence he pleaded guilty to the current charges but not before asking that she recuse herself from his trial. She didn’t consider his application.
Other grounds he cites are animosity between himself and Her Worship Nankya as well as today’s events where Mr Mabirizi says that without any evidence of immorality, national security or public order considerations, Her Worship Nankya chased non-press accredited individuals, including his assistants from the trial.
This, he said violated his Article 28 Constitutional rights.
The excluded assistants are: Mr Simon Muhindo, Mr Abdallah Tebuko and Mr Hussein Abbas who are all law students at KIU (for the first two) and IUIU for Mr Abbas.
The state, represented by Chief State Attorney, Joan Keko said that an application for recusal is a road block to a trial and they couldn’t proceed without a ruling from the judicial officer.
Her Worship Nankya had to adjourn the matter to 2:30 pm to give her ruling.

The EAC framework is founded on the progressive free movement of people, goods, services and capital. Where individuals are found to be in violation of national immigration or other laws, enforcement should be orderly, lawful, humane and free from collective punishment or hostility towards any nationality.
I urge the East African Community leadership to engage Kenya, Burundi and other Partner States urgently to address these concerns through dialogue and established regional mechanisms.
At the same time, Burundi faces serious economic pressures that are pushing some of its citizens to seek opportunities elsewhere. I appeal to the Government of Burundi to intensify measures addressing these economic hardships.
Our region must choose cooperation over xenophobia, lawful enforcement over mob action, and economic integration over division. East Africans should never become strangers to one another in East Africa.
