Yeah he should. Watch the video again. He knew he pulled his pistol. When he pulls it out and goes to fire it (right after he said stop running or imma fucking tase you) he has safety on. He flips the safety, raises the firearm back up, fires, misses, and then holsters it and switches to the taser. At that point he tried to cover it because he just shot the taser into thin air with no effort on aim. He put more effort in aiming the pistol than he did the taser.

This man wanted to kill that guy. There’s no doubt about that in the slightest.
