The State of #Israel submitted to the #ICJ its Counter-Memorial in the baseless and libelous proceeding initiated by South Africa in December of 2023, less than three months after the 7 October massacre and subsequent attacks.
As demonstrated in the Counter-Memorial, Israel comprehensively dispels the fundamentally heinous and vicious claims that South Africa laid before the Court, which attempt to morph reality and distort the very tenets upon which international law was founded.
Israel has demonstrated that the Court is without jurisdiction in this case; and that South Africa’s allegations are wholly unfounded in both fact and law and ought to be rejected.
Israel is painfully aware of what genocide is. Nothing in Israel's intentions and conduct in defending itself against those who openly seek its annihilation bears any relation to that crime.
As Israel amply proves in its Counter-Memorial, its legitimate objectives in the war have always been to eliminate the military and governing capabilities of Hamas and other terrorist organizations in order to ensure the safety of Israel's citizens, and to return the hostages. Israel is and has always been committed to uphold its obligations under the Genocide Convention. Any claim to the contrary seeks to undermine the fundamental right and obligation of States to lawfully defend themselves against murderous terrorist armed groups committed to their destruction and the integrity of international law itself.

Following the launch of Operation Rising Lion in the early morning of Friday, 13 June 2025, Israel submitted yesterday a letter to the Security Council.
The letter’s bottom line: Operation Rising Lion was launched as part of the ongoing armed conflict between the IRI and Israel, in light of the existential and imminent threat from Iran's nuclear weapon and ballistic missile programs. The operation is in strict compliance with international law.

- Iran has engaged in an armed conflict with Israel for years, directly as well as indirectly, through various proxies in the middle east. One recent peak of this ongoing armed conflict was marked by Iran’s missiles and UAV attacks on Israel during April and October of 2024, historically unprecedented in their scope. Accordingly, Israel’s actions should be assessed in light of the law of armed conflict.
- As part of this ongoing conflict Israel was faced with an existential and imminent threat, a threat Iran expressed the intention, and sought the capabilities, to realize. Israel had no choice but to act now, in the last window of opportunity. Operation Rising Lion was launched as a last resort, after diplomatic channels were exhausted and proved inadequate.
- Israel’s actions are necessary and proportionate, in line with the laws of armed conflict. Isreal’s strikes during operation Rising Lion are carried out against military objectives, such as: Iranian nuclear facilities that constitute part of the Iranian nuclear weapon program, Iran's ballistic missile capabilities, military assets, senior military commanders, as well as other individuals who directly participate in hostilities against Israel. Israel takes measures to mitigate civilian harm to the extent feasible, and avoid attacks that are expected to cause excessive collateral damage in relation to the military advantage anticipated.
- The IRI has launched since 13 June 2025 hundreds upon hundreds of missiles and UAVs, while deliberately targeting Israeli civilian population centres - in violation of the law of armed conflict.
I extend my deepest condolences to the families of the victims who lost their lives as a result of Iran's attacks. May their memory be a blessing. I also wish a speedy recovery to all those injured in the missile attacks.
We never forget that 53 hostages remain captive in Hamas hands. Israel will do everything in its power to bring them home.

Warrants issued before establishing jurisdiction? Last week, the #ICC Appeals Chamber reversed the Pre-Trial Chamber's decision on Israel's jurisdictional challenge, remanding it for proper review.
This underscores an alarming situation: arrest warrants issued before establishing the most fundamental requirement for any court—jurisdiction.
This continues the unimaginable situation where States are expected to honor warrants lacking a determined legal basis under the Court's own rules. This is an unacceptable legal standard in any situation, let alone one that concerns a State not party to the Court.

On Wednesday, Hamas submitted an application in the UK seeking "its removal from the list of proscribed organizations". The application is one that brazenly justifies terror, is unapologetic about Hamas's methods and seeks to distort facts, including on Hamas's actions on October 7th.
As part of the application, Professor John Dugard, South Africa's lead counsel in the ICJ genocide case, without even attempting to distance himself from the various despicable claims in the application and the association with Hamas, filed an expert opinion (regarding "Israel 'right to exist"). Needless to say Dugard's opinion regarding Israel's right to exist is that "no such right exists under international law and that no adverse consequences should flow from Hamas' refusal to recognise the same."
As Israel has been saying all along, the baseless proceeding in the ICJ is being promoted by those interested in aiding Hamas while tarnishing Israel's image and denying it the right to defend itself and its citizens from the same murderous terrorist organization that is, in fact, the one promoting a genocidal agenda. And here it is, on full display.
If anyone needed proof of how the Court's investigation against a democratic state fighting terrorism plays into the hands of terror organizations - look no further.

Important news: on Friday, #Israel filed its detailed appeal memorandums regarding the #ICC Pre-Trial Chamber’s decisions which wrongfully allowed for the issuance of arrest warrants against Israel's Prime Minister and former Minister of Defense.
The Pre-Trial Chamber’s improper application of jurisdiction and complementarity principles erodes the legal foundations upon which the ICC was established, with far-reaching implications for the ability of states to present their claims and ensure these principles are upheld.
As detailed in Israel's appeal memorandums, the gravity of these errors warrants their immediate reversal and the nullification of the arrest warrants.

While you are drinking your coffee there are over 100 Israeli men, women and children being held hostage in Gaza.
Many of them have not seen daylight in months.
We will not rest until every last hostage is home.
To mark the 4th of July, a short note on some international law aspects of the US-Israel friendship.
1. The strong bonds between the US and Israel go back 76 years, as the United States recognized the State of Israel soon after the Declaration of Independence. The US was also the first to formally recognize Jerusalem as Israel’s capital, in 2017.
2. Countless treaties and MOUs in fields such as security, R&D and legal cooperation have been signed over the years between the US and Israel. These describe, often in legal terms, the contours of the the US-Israel friendship. They create the legal space, so to speak, for the various bilateral interactions to occur.
3. More mundane but no less meaningful, is the continued collaboration between US and Israeli officials in various international forums, which contributes greatly to the development of international law. It occurs on a routine basis, between officials of both countries, in many fields of activity (e.g. between the US
DoJ and Israel's Ministry of Justice @JusticeGov).
President @Isaac_Herzog, in his address to Congress last year, noted: “Our two nations are both diverse, life-affirming societies that stand for liberty, equality, and freedom. At our core, both our peoples seek to repair the cracks in our world.” These shared values, along with a commitment to upholding international law in facing global challenges – have enabled this relationship to endure.
