[SBS Entertainment News] Actor #KimSoohyun has been cleared of allegations that he violated the Child Welfare Act in connection with the late Kim Sae-ron.

The Seongdong Police Station, which investigated the case, recently decided not to refer Kim Soo-hyun to prosecutors on the Child Welfare Act allegations.

Previously, Kim Sae-ron's family and Kim Se-ui, head of the Garosero Research Institute (Garo Sero Institute), claimed that Kim Soo-hyun had been in a relationship with Kim Sae-ron while she was still a minor. Based on those allegations, they filed a criminal complaint against him in May of last year for alleged violations of the Child Welfare Act.

At the time, Kim Se-ui and attorney Boo Ji-seok held a press conference where they released what they claimed was an audio recording of Kim Sae-ron's voice before her death. The recording alleged that:

"She had been dating Kim Soo-hyun since the second year of middle school and had sexual relations with him."

However, investigators ultimately concluded that the recording had been fabricated.

According to the Gangnam Police Station in Seoul, in the application for Kim Se-ui's arrest warrant submitted to prosecutors, both the KakaoTalk conversation presented during the press conference as evidence of the alleged relationship and the audio recording purported to contain Kim Sae-ron's voice were determined to have been fabricated.

[Case Details & Background]

1️⃣ Origin of the Allegations

Accusing Parties:
The allegations were brought forward by the family of the late actress Kim Saeron, together with Kim Seeui, the operator of the controversial YouTube channel Garo Sero Research Institute (Gaseyeon).

Nature of the Allegations:
They publicly claimed that Kim Soohyun had been in a romantic relationship with the late Kim Saeron while she was still a minor. They further alleged that Kim Soohyun had committed physical, sexual & emotional abuse in violation of the Child Welfare Act. Based on these claims, they filed criminal complaints against Kim Soohyun for alleged violations of the Child Welfare Act & for making false accusations.

2️⃣Police Investigation Results (Seongdong Police Station)

The Seongdong Police Station conducted a comprehensive investigation & ultimately reached a “No Charges / Non-Referral for Prosecution” (불송치) decision.

Scope of the Investigation:
The investigation was not limited to the late Kim Saeron’s early childhood. Instead, the police examined the entire period up until she was in her 3rd year of high school covering all the yrs during which she was legally under the age of 18 & therefore considered a child/minor under the Child Welfare Act.

Police Findings:
After reviewing all evidence submitted by the accusers & thoroughly examining witness statements, the nature of the relationship & the factual circumstances at the time, the police concluded that there was no evidence or legal basis to support the allegations that Kim Soohyun had dated or sexually or emotionally abused the late Kim Saeron while she was a minor.

3️⃣Legal Clarification by Kim Soohyun’s Attorney (Ko Sangrok)

Kim Soohyun’s attorney provided several important legal clarifications to address public misunderstandings.

🏷️ Meaning of the Non-Referral Decision (불송치 결정)

The police’s decision doesnt mean that the authorities have postponed their judgment or are waiting for the outcome of another court case.

Rather, it’s an official determination by the investigative authorities that the alleged conduct doesnt constitute a criminal offence. As a result, the investigation was formally concluded without referring the case to the prosecution.

🏷️Difference Between This Case & Kim Seeui’s Upcoming Trial

The upcoming criminal trial involving Kim Seeui & the related parties isnt a trial to determine whether Kim Soohyun is guilty or innocent.

Instead, the trial will examine whether Kim Seeui & his associates committed criminal offences by spreading false information, manipulating evidence & defaming Kim Soohyun.

Kim Soohyun’s legal team emphasized that the public perception that “we must wait for Kim Seeui’s trial to know whether Kim Soo-hyun is guilty or innocent” is a serious misunderstanding of the law. The two cases are legally independent & entirely separate proceedings.

4️⃣Conclusion

Kim Soohyun’s Legal Status:
Kim Soohyun has been fully cleared of the allegations of violating the Child Welfare Act & the related criminal accusations. The case against him has been officially concluded.

What Comes Next:

Actor #KimSoohyun has been cleared of allegations of violating the Child Welfare Act. Authorities concluded that claims by the family of the late Kim Sae-ron alleging sexual abuse of a child were unfounded.

Kim Soo-hyun has now overcome another legal hurdle. Earlier allegations that he dated Kim Sae-ron while she was a minor had already been determined to be false. Additional accusations of child sexual exploitation have also been dismissed, with police deciding not to pursue charges.

The Seongdong Police Station recently decided not to refer Kim Soo-hyun to prosecutors on allegations of violating the Child Welfare Act and filing a false accusation. Investigators focused on whether Kim had been in a relationship with the deceased before she turned 18 and whether any sexual abuse had occurred. Police concluded that all allegations claiming they had dated while she was a minor were false.

Last May, Kim Sae-ron's family and Kim Se-ui filed a criminal complaint accusing Kim Soo-hyun of violating the Child Welfare Act and making false accusations. Their complaint was based on statements made during a press conference held by Kim Se-ui and attorney Boo Ji-seok.

In the complaint, the family alleged:

"In 2014, when Kim Sae-ron was a second-year middle school student (14 years old), Kim Soo-hyun had sexual intercourse with her and forced her to engage in obscene acts, constituting sexual abuse."

During the press conference last May, Kim Se-ui and attorney Boo Ji-seok presented what they claimed was an audio recording of Kim Sae-ron's voice, describing it as a genuine conversation between the late actress and an acquaintance in New Jersey. They argued that the recording proved Kim Soo-hyun had sexually exploited a child.

They specifically claimed that Kim Sae-ron's first sexual encounter with Kim Soo-hyun occurred when she was 14 years old, citing the following portion of the recording as key evidence:

New Jersey acquaintance:
"So, did you only have sex with him after you became an adult?"

Kim Sae-ron:
"No... The first time I did it with that bastard was during the winter break of my second year of middle school."
New Jersey acquaintance:
"Wow, second year of middle school?"

Kim Sae-ron:
"Thinking about it now... maybe I should say I was taken advantage of."
However, the central issue was that the recording itself was determined to be fake.

According to the article, the voice attributed to Kim Sae-ron had been artificially generated using AI. The Forensic Science Division of the Supreme Prosecutors' Office reportedly found evidence of manipulation, stating that the frequency characteristics of the male and female voices differed, indicating the recording had been fabricated.
The alleged "New Jersey acquaintance" featured in the recording has also never been identified. It remains unverified whether such a person actually lives in New Jersey or ever met Kim Sae-ron. Police continue to classify the individual as unidentified, and the possibility that the voice was also AI-generated has not been ruled out.

Despite this, Kim Se-ui reportedly maintained that he had conducted an on-site investigation in New Jersey and insisted that the recording was authentic. Based on that recording, Kim Sae-ron's family proceeded with the criminal complaint, expanding earlier allegations of underage dating into accusations of child sexual exploitation.
The complaint stated:

"Kim Soo-hyun had sexual relations with Kim Sae-ron, who lacked the ability to fully exercise her right to self-determination and protect herself, and forced her to engage in obscene acts. These constituted sexual and emotional abuse harmful to the mental health and development of a child."

Meanwhile, Kim Se-ui was indicted and detained on June 23 on charges including the dissemination of false information concerning Kim Soo-hyun. He is currently being held at the Seoul Detention Center, with his first trial scheduled for August.
