UP Govt Breaches its Undertaking in High Court?

Facts of the 91% Reservation Matter in UP:
-4 medical colleges in UP (at Ambedkar Nagar, Kannauj, Jalaun and Saharanpur) have implemented 91.76% reservation (SC 72.94%, ST 5.88%, OBC 12.95%, UR 8.24%).

-This was challenged in Allahabad High Court in 2025.
Govt argued that these 4 colleges were established under SCP (Special Component Plan) for Scheduled Castes, so more reservation for them.

-Allahabad High Court (single bench) quashed this order and said that 50% cap can’t be breached.

-The UP Government appealed the single-judge judgment. A Division Bench comprising Justice Rajan Roy and Justice Manjive Shukla heard the appeal. The Division Bench did not finally decide the underlying reservation question at that stage but allowed old reservation matrix for current year (2025-26) as admissions were already completed.

-UP Govt gave an undertaking that it would follow correct reservation matrix (in 2026-27 academic year).

-However, in 2026-27 academic year, the State has restored the same old seat arrangement, that potentially amounts to a breach of the undertaking on the basis of the order itself.

अब सरकार दलितों के लिए एक्सक्लूसिव कॉलेज खोल रही है, हमारे पैसों से!

उत्तर प्रदेश के चार सरकारी मेडिकल कॉलेज- अम्बेडकर नगर, जालौन, कन्नौज और सहारनपुर- में 2026-27 की सीट मैट्रिक्स फिर वही पुरानी व्यवस्था पर जारी हुई है।

प्रत्येक कॉलेज की 85 राज्य कोटा सीटों में: एससी: 62 सीटें (लगभग 73%), एसटी: 5 सीटें (लगभग 6%), ओबीसी: 11 सीटें (लगभग 13%), अनारक्षित/जनरल: सिर्फ 7 सीटें (लगभग 8%) हैं, यानी कुल आरक्षण लगभग 92% हो गया है।

सरकार की धूर्तता देखिए कि इन्होंने ये चार कॉलेज एससी स्पेशल कंपोनेंट प्लान (एससीपी) के तहत बनवाए थे। यानी अब खुल्लमखुल्ला जाति के आधार पर केवल दलितों के लिए कॉलेज तो बन रहे हैं, पर हर नए कॉलेज में 60% सीटें आरक्षित रहेंगी! @myogiadityanath या @narendramodi जब चार कॉलेज दलितों के लिए बनवाते हैं, तो चार केवल अनारक्षित के लिए बनवा लेते!

सरकार का तर्क यही है कि चूँकि फंड एससी कल्याण के लिए था, इसलिए यहाँ सामान्य 21%+2%+27% फॉर्मूला लागू नहीं होता। अगस्त 2025 में इलाहाबाद हाईकोर्ट की लखनऊ बेंच ने 2010-2015 के उन शासनादेशों को रद्द कर दिया था जो 50% की सीमा पार करते थे।

कोर्ट ने साफ कहा था कि इंदिरा साहनी फैसले और यूपी आरक्षण अधिनियम 2006 के मुताबिक सामान्य फॉर्मूला लागू हो। सरकार ने विशेष अपील दाखिल की और 2026 की काउंसलिंग में पुरानी 62-5-11-7 व्यवस्था ही जारी रखी। मामला सुप्रीम कोर्ट में भी लंबित है।

My neighbour smoked 30 cigarettes yesterday. No lung cancer, no asthma, no breathing issues. The anti smoking propaganda is crashing hard against ground reality - My neighbour got this right, despite he claiming in High court that he has nothing to do with smoking.
