IPOB PRESS STATEMENT
SUBJECT: Onyendu Mazi Nnamdi Kanu Accepts In Toto the Federal Government's Cross-Appeal Damning Admission: Trial Court Acted Without Jurisdiction — A Total Collapse That the Court of Appeal Cannot Cure
The Indigenous People of Biafra (IPOB) wishes to draw the attention of the world, the international community, and all men of conscience to yet another spectacular self-inflicted wound by the APC-led Federal Government of Nigeria in its desperate attempt to keep Onyendu Mazi Nnamdi Kanu in perpetual bondage.
In its Notice of Cross-Appeal filed against the judgment of the Federal High Court, Abuja (Coram: Hon. Justice J.K. Omotosho), delivered on the 20th day of November, 2025, the Federal Government unequivocally declared in black and white that the trial Court acted without jurisdiction when it imposed life imprisonment on Counts 1, 2, 4, 5 and 6.
Onyendu Mazi Nnamdi Kanu, the indefatigable Lion of Biafra and Leader of the Indigenous People of Biafra, accepts this premise in toto. We adopt the Federal Government’s own words as our own. If the trial Court acted without jurisdiction at the sentencing phase, then the entire sentencing exercise is a nullity ab initio. Jurisdiction is not divisible. It is a sacred continuum. You cannot validly convict a man and then lack jurisdiction to sentence him on the same counts. That is judicial absurdity.
As the Supreme Court made clear in the immortal Madukolu v. Nkemdilim (1962), once there is a feature in the case that prevents the court from exercising jurisdiction, the entire proceedings are null and void no matter how well conducted. The Federal Government has now supplied that fatal feature through its own pleading. With the greatest respect, the Court of Appeal lacks the power to repair, cure, or resuscitate what the Respondent itself has declared jurisdictionally dead.
The FG cannot approbate and reprobate. They cannot admit the sentencing phase was conducted without jurisdiction and in the same breath urge the Court of Appeal to impose the death penalty on that same rotten foundation. This is not law; this is legal gymnastics born out of desperation and bad faith.
If the ill-thought-out Cross-Appeal orchestrated by the Attorney General of the Federation, Prince Lateef Fagbemi, SAN, Chief Awomolo, SAN, and the Yoruba APC Presidency is aimed at intimidating Onyendu Mazi Nnamdi Kanu into renouncing Biafra, then they have grossly miscalculated. Mazi Nnamdi Kanu is the reincarnation of the indomitable Biafran spirit and will never yield to such cheap blackmail. Other former freedom fighters may be cowards, but not Onyendu Mazi Nnamdi Kanu. To the FG, we say: bring it on.
This self-destructive Cross-Appeal is a clear manifestation of divine intervention and the inevitable collapse of the entire fabricated case against Onyendu. The Federal Government has handed us the sledgehammer to demolish their own conviction. The sentencing is void. The foundation is shattered. The entire prosecution stands on quicksand.
We call on the Court of Appeal to do justice by dismissing the Cross-Appeal with ignominy and allowing the Appellant’s main appeal in its entirety, leading to the immediate and unconditional release of Onyendu Mazi Nnamdi Kanu.
The world is watching. History is watching. No amount of judicial acrobatics or cheap intimidation can cure a fundamental lack of jurisdiction. The Lion of Biafra remains unbowed, and the spirit of Biafra remains unconquerable.

Nigeria: Genocidal threat against Ndigbo by Afenifere Chieftain and Presidential silence validates Mazi Nnamdi Kanu's call for a Peaceful Referendum
By Charles Obinna Chukwunaru, PhD
The structural coherence of the Nigerian state has long been sustained by a fragile consensus that is increasingly compromised by existential internal contradictions. A definitive manifestation of this systemic vulnerability emerged through the public declarations of Afenifere chieftain Akin Fapounda, who explicitly threatened Ndigbo with ethnic cleansing should an Igbo win the 2027 presidential election.
This rhetoric cannot be dismissed as marginal political commentary. It represents a functional articulation of deep-seated structural hostilities within the ruling establishment; and its timing operates as a calculated psychological assault on Ndigbo. It was intentionally delivered just days before the solemn global commemoration of the 1966 anti-Igbo pogroms and the subsequent genocidal civil war.
By invoking frameworks of mass annihilation precisely when millions of Ndigbo mourn over three million lives lost to State sponsored violence, the threat actively weaponizes historical trauma to enforce political subjugation.
The most critical diagnostic indicator of Nigeria's state failure is the absolute, complicit silence emanating from Aso Rock Villa. President Bola Ahmed Tinubu’s refusal to arrest, investigate, or publicly denounce this overt threat of ethnic cleansing signals executive validation. Under international jurisprudence, when a sovereign state fails to penalize direct incitement to eliminate a protected group, it transitions from a passive observer to an active accomplice. This calculated silence converts democratic participation into an existential hazard for Ndigbo, proving that the contemporary state architecture remains indifferent to the targeted destruction of its Igbo citizens.
This dynamic entirely validates the persistent alarms raised by Mazi Nnamdi Kanu regarding the systematic vulnerability and targeted endangerment of Ndigbo within Nigeria. The precise threats he foretold are now openly declared by political elites. This systemic vindication amplifies the legal and moral necessity for his immediate and unconditional release.
The ongoing crisis reinforces the core position of the Eastern Nigeria Development Association (ENDA). The structural architecture of Nigeria has been fundamentally broken since the catastrophic pogroms of 1966, failing to provide basic security, equity, and judicial neutrality to Eastern Nigerians and Ndigbo in particular. Under Article III of the 1948 UN Genocide Convention, direct and public incitement to commit genocide is a distinct international crime.
Furthermore, Article 1 of both the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR) explicitly protects the right of all peoples to self-determination. This is supported by Article 20 of the African Charter on Human and Peoples' Rights, which Nigeria has fully ratified, guaranteeing oppressed peoples the right to free themselves from oppression.
When peaceful democratic alignment is met with threats of physical liquidation, the forced amalgamation of Nigeria ceases to be a viable political option and becomes an active security threat.
ENDA makes an urgent, formal appeal to the United Nations Security Council and African Union to intervene immediately to protect the lives of Ndigbo in Nigeria. The international community must move beyond diplomatic deference and recognize Mazi Nnamdi Kanu’s call for a peaceful referendum as the only rational, non-violent mechanism to avert a humanitarian catastrophe and secure the self-determination and preservation of the peoples of Eastern Nigeria/Biafra.

PRESS RELEASE: 21st July, 2026
RE: Kanu’s legal team condemns call for his extrajudicial killing, demands retraction and apology
Mazi Nnamdi Kanu’s legal team hereby strongly condemns the statement made by one Mr. Chigozie Nnabugwu on News Central TV, in which he publicly urged the Government of Nigeria to kill our client for ‘normalcy to return to the Southeast.’
The video bearing this statement was published at 1:14PM on 19th July 2026 by News Central Television at its verified X (formerly Twitter) handle, monitored at: @NewsCentralTV, and it went viral from that source.
To be sure, this call for extrajudicial killing is reckless, irresponsible, and unlawful. And it constitutes a clear threat to life and risks inciting a breakdown of public order.
The call strains the boundaries set under Section 24(1) of the Cybercrimes Act, which criminalises the knowing or intentional transmission of messages via electronic means (including those amplified on broadcast platforms and social media) that pose a threat to life or are intended to cause a breakdown of law and order, which carries a fine of up to ₦7m or imprisonment of up to three years or both.
Additional liabilities will likely be triggered under the Criminal Code for incitement to violence and related offences.
Furthermore, by airing and platforming this inflammatory content without due regard for its potential to incite violence or threaten public peace, News Central TV may face regulatory sanctions for breach of broadcast codes on incitement and public order.
It may also attract accessory liability or contributory exposure under relevant laws. Broadcasters enabling hate speech and calls for extrajudicial killing risk severe regulatory sanctions and other countervailing measures.
And demanding an extrajudicial execution while legal proceedings remain before the court directly subverts the judicial process and potentially constitutes actionable contempt of court.
We are actively reviewing all available legal options, including formal complaints to the appropriate authorities.
In the interim, we hereby demand that Mr. Chigozie Nnabugwu issue an immediate public retraction of his statement, and that News Central TV tender an unqualified televised apology for airing such dangerous content.
Finally, this Press Release serves as a pre-action notice of all legal actions that will ensue if Mr. Nnabugwu and News Central TV fail to take immediate remedial measures.

FOURTEEN DAYS TO STOP HIS RELEASE. MONTHS OF DELAY WHEN HE SEEKS FREEDOM. WHY?
Mazi Nnamdi Kanu Writes Chief Justice of Nigeria and President of the Court of Appeal Asking for His Cases to Be Listed Immediately
Federal Government Shows No Willingness to Join Issues in Either Court
United States Congress, Israeli Knesset and International Bar Association Will Be Formally Notified
The Okwu-Kanu Family wishes to inform Nigerians and the international community that Mazi Nnamdi Kanu has now written separately to the Chief Justice of Nigeria and the President of the Court of Appeal requesting the immediate listing and hearing of his two pending cases.
The reason is simple.
The Federal Government has shown no sign of willingness to join issues in either proceeding, while Mazi Nnamdi Kanu remains in detention serving a life sentence.
He is not asking for special treatment.
He is asking the Nigerian judiciary to show the same urgency when his freedom is at stake that it showed when the Federal Government wanted to stop his release.
The benchmark was set by the judiciary itself in October 2022.
FOURTEEN DAYS TO STOP HIS RELEASE
On 13 October 2022, the Court of Appeal delivered its final judgment discharging Mazi Nnamdi Kanu and quashing the criminal counts against him.
It was an acquittal-equivalent discharge.
The Federal Government refused to release him.
By 28 October 2022—barely two weeks later—the Federal Government had filed, listed, argued and obtained a civil stay of execution from a differently constituted panel of the same Court of Appeal, even though the criminal appeal had already been finally determined and the Court was functus officio.
The stay stopped Mazi Nnamdi Kanu from enjoying the liberty granted by his acquittal-equivalent discharge.
Fourteen days.
In fourteen days, the machinery of the Court of Appeal moved from an acquittal-equivalent discharge to a civil stay that kept Mazi Nnamdi Kanu in detention.
The criminal appeal had already been finally determined. The Court was functus officio. Yet a differently constituted panel was assembled and civil procedure was deployed to restrain liberty arising from a concluded criminal proceeding.
That is the constitutionally impermissible hybridisation of civil and criminal procedure at the heart of the 28 October 2022 order.
A civil stay is not a criminal charge.
A civil stay is not a remand warrant.
A civil stay does not revive quashed criminal counts.
And a civil procedural rule cannot be transformed into a criminal power to keep a discharged person in detention.
To our knowledge, never before in Nigeria has a civil procedural rule been deployed in this manner to deny liberty to a person following an acquittal-equivalent discharge. Mazi Nnamdi Kanu appears to be the first and only person subjected to it.
The common-law world should take notice of what occurred:
A finally determined criminal appeal.
A functus officio Court of Appeal.
A differently constituted panel.
Civil procedure imported into a concluded criminal case.
And the result was continued detention of the man the same Court of Appeal had discharged fourteen days earlier.
FOURTEEN DAYS THEN. MONTHS NOW.
Where is that same urgency today?
Mazi Nnamdi Kanu commenced proceedings before the Supreme Court on 7 November 2025, challenging the legality of the Supreme Court's remittal judgment of 15 December 2023.
The Federal Republic of Nigeria was served.
More than nine months have passed.
According to the records available to the family, the Government has filed no substantive response.
The case has not been listed for hearing.
There is also a separate appeal before the Court of Appeal challenging Mazi Nnamdi Kanu's 20 November 2025 conviction and life sentence.
According to Ejimakor, “Buhari has to release Kanu, because it is the right thing to do. The refusal to release him means that his detention has turned extrajudicial. Kanu is now a political prisoner & it cannot stand, not for long”

PRESS RELEASE
Mazi Nnamdi Kanu Challenges Legality of His Trial — Demands Prosecution Identify Valid Law Behind Charges
Abuja, October 27, 2025 — Proceedings in the case of Federal Republic of Nigeria v. Mazi Nnamdi Kanu took a decisive turn today before Justice James Omotosho of the Federal High Court, Abuja.
During the hearing, Mazi Nnamdi Kanu, who appeared in person, firmly maintained that there is no valid or subsisting charge known to law against him. Despite repeated cajoling and pressure from the judge and the prosecution team led by Chief Adegboyega Awomolo, SAN, Kanu insisted that the learned silk should read into the record or restate the law under which he is being charged and asked to enter a defence.
Chief Awomolo, SAN, was unable to identify any existing legal provision creating the offence alleged against Kanu, effectively confirming the defendant’s long-standing position that the entire proceeding lacks a legal foundation.
Justice Omotosho, in response, directed Mazi Kanu to file a written address within four (4) days on the validity of the charge and serve same on the prosecution. The Court expressly resisted all attempts by the prosecution to convert the forthcoming address into a final defence address, emphasizing that the issue before the court remains the validity of the charge itself, not the merits of any defence.
Today’s development underscores Mazi Kanu’s unyielding stance that his continued trial constitutes an unlawful process, being anchored on no known or valid law. His position remains clear: “There can be no defence where there is no valid charge.”
As soon as the court or prosecution team identify any known law that is extant and subsisting in Nigeria’s corpus juris, Mazi Nnamdi Kanu will enter his defence and witnesses he listed will be called.
