PANDANGAN SYARIAH DARIPADA PAKAR MUAMALAT.

Dua hari lepas ada kawan saya call bertanya tentang NGO yang berjaya mengutip derma Palestin sebanyak RM114 juta dan mengambil caj pengurusan sebanyak RM34 juta.

RM34 juta adalah angka yang cukup besar. Kira-kira 29% untuk caj pengurusan!

Kawan saya kata, "Baik kita berniaga macam ini lah ustaz!

Saya hanya ketawa kecil sahaja. Tetapi ada betul juga yg kawan saya sebut itu.

Sekarang ini, NGO tumbuh bagaikan cendawan selepas hujan. Berpuluh-puluh NGO kita lihat untuk Palestin, Syria, Kemboja dan sebagainya.

Saya difahamkan kerajaan membenarkan NGO mengambil 30% daripada jumlah derma untuk urusan NGO. Namun jika tiada sebenarnya peraturan 30% itu maka atas dasar apa NGO itu ambil kos pengurusan sampai 29%?

Bukankah ini namanya perompak pada siang hari?

Kita andaikan peraturan 30% itu wujud. Kalau NGO dapat kutip RM100K maka NGO boleh ambil RM30K. Jika NGO dapat kutip RM1juta maka NGO boleh ambil RM300K.

Wow! Hebat betul bisnes derma ini. Apatah lagi rakyat Malaysia terkenal dengan sikap dermawan. Kita juga jarang bertanya adakah duit derma itu benar-benar sampai ke tempatnya sebab kita sentiasa bersangka baik.

Jika NGO menggunakan marketing kaw-kaw dan ustaz selebriti sebagai duta NGO. Pasti duit derma masuk mencurah-curah tanpa henti.

Bisnes derma ini memang berbaloi!

30% adalah peraturan kerajaan namun daripada perspektif syariah, bolehkah NGO mengambil peratusan tertentu daripada wang derma tersebut?

Apabila NGO menubuhkan dana kebajikan maka NGO bertindak sebagai wakil kepada penderma (muwakkil) untuk salurkan bantuan ke tempat yang berkenaan.

Ini merujuk kepada konsep Wakalah. Wakil perlu bertindak mengikut arahan muwakkil. Jika dana dibuka untuk membina sekolah tahfiz maka duit derma itu perlu disalurkan untuk pembinaan bangunan sekolah tahfiz. Dalam wakalah, perlu dinyatakan dengan jelas bayaran kepada wakil atau wakalah tanpa upah.

Jika NGO ingin caj kos pengurusan maka NGO perlu nyatakan dengan jelas bahawa ada peratusan tertentu digunakan untuk kos pengurusan NGO. Jika NGO mengambil kos pengurusan tanpa memberitahu kepada penderma maka NGO itu telah mengkhianati amanah.

Darul Ifta' Jordan, majlis fatwa berautoriti Jordan menyatakan seperti berikut:

الوكيل مؤتمن وما يدفع إليه من أموال الصدقات أمانة عنده يجب عليه أن يحفظها ويؤد��ها، وإلا كتب عليه وزر الخيانة، وإن تصرف فيها بغير الوجه المحدد له أو قصر في حفظها فقد تعدى وأثم، ويكون ضامناً لذلك المال، ولا تبرأ ذمته منه إلا بدفعه، يقول الله عز وجل: (يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَخُونُوا اللَّهَ وَالرَّسُولَ وَتَخُونُوا أَمَانَاتِكُمْ وَأَنْتُمْ تَعْلَمُونَ. (الأنفال:27)

"Wakil sifatnya boleh dipercayai. Apa sahaja wang yg diberikan kepadanya adalah amanah dan dia mesti menjaganya dan menyalurkannya.

Jika tidak, dosa khianat akan ditulis ke atasnya. Jika wakil menguruskannya dgn cara lain daripada ditentukan atau tidak menjaganya dengan baik maka dia telah melampaui batas dan berdosa. Dia menjadi penjamin wang itu dan tidak terlepas daripada tanggungjawab melainkan membayarnya. Allah berfirman:

يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَخُونُوا اللَّهَ وَالرَّسُولَ وَتَخُونُوا أَمَانَاتِكُمْ وَأَنْتُمْ تَعْلَمُونَ.

"Wahai orang yang telah beriman, janganlah kamu mengkhianati Allah dan Rasul dan mengkhianati amanah-amanah kamu, sedang kamu mengetahui (salahnya)" (Surah Al-Anfal: 27)

Sekiranya NGO ingin mengambil peratusan daripada wang derma untuk urusan NGO maka NGO perlu memaklumkan kepada penderma terlebih dahulu.

Darul Ifta' Jordan menyebut seperti berikut:

فإذا أراد أن يأخذ من الصدقات فعليه أن يستأذن المتبرعين بذلك، فإن لم يفعل فقد خان الأمانة، واستجاب لما يلبسه الشيطان عليه، ويجب عليه التوبة والاستغفار.

"Jika institusi ingin mengambil daripada wang derma, institusi mesti meminta izin daripada penderma untuk berbuat demikian.

Jika institusi tidak melakukannya maka ia telah mengkhianati amanah dan terpedaya dgn belitan syaitan. Ia wajib bertaubat dan memohon keampunan."

🚨EXPERT ANALYSIS: WHO BOMBED THE AL AHLI BAPTIST HOSPITAL IN GAZA?

Marine Corps Veteran expert analysis of the recent bombing incident at the hospital reveals critical findings:

- Fuel Explosion Duration: The initial explosion likely lasted 0.5-0.75 seconds, emitting light for a brief period. This suggests it is not an incendiary device.

- Parking Lot Damage: The damage in the parking lot is attributed to either overpressure or a fuel explosion. There's minimal debris near the cars.

- Shielding Effect: A surrounding building shielded one side of the parking lot, preventing diesel/gas fires from reaching the vehicles. All windows in nearby buildings shattered due to the primary and fuel explosions.

- Last Video Variation: The final video displays a smaller fuel explosion, and the submunition release is less clear.

CONCLUSION:

- The explosive device likely ranged from 300-600 lbs. Larger bombs would've scattered more debris in the parking lot than on buildings.

- A 700lb+ bomb would've caused more damage to building tops due to shockwaves.

- Most visible damage is attributed to the fuel explosion; the primary explosion likely caused structural damage.

Probable munitions and their possessors:

1. Mk-82/Mk-83 General Purpose Bombs:
- Possessed by: Multiple countries, including the US and NATO members. Versatile, unguided bombs.

2. GBU-39 Small Diameter Bomb (SDB):
- Possessed by: United States and allies. Known for precision strikes.

3. GBU-12 Paveway II Laser-Guided Bomb:
- Possessed by: United States and allies. Converts unguided bombs into precise munitions.

4. AGM-65 Maverick Missile:
- Possessed by: United States and allies. Air-to-surface missile for precision strikes.

Audio Analysis: Based on the video, we can hear what the Hamas missiles and a JDAM missile sound like. Then, we have the audio of the attack on the hospital, and it sounds very similar to a JDAM missile. Hamas does not have the infrastructure and capabilities to fire a JDAM.

These insights offer clarity into the incident, highlighting potential munitions and the militaries that may possess them, and that could have been behind the attacks.

FINAL CONCLUSION:

Based on the evidence, this could not have been the Islamic Jihad, as claimed by the Israeli Defense Force, based on our analysis of the information we have so far.

They do not possess the capabilities for such advanced weaponry.

IMPORTANT DISCLAIMER:

This is an analysis is preliminary, and is done by a Marine Corps Veteran Explosives & Ordinance Expert, and reviewed by many others.

As I've said before, we CANNOT come to final conclusions just yet.

The IDF has denied the above claims, and has stated it shared evidence with US Intelligence, including footage and intercepted conversations, that will prove the Islamic Jihad were behind the bombing of the Al-Ahli Baptist Hospital. This footage and the conversations will also be made public, according to Reuters.
