#DRC: Having stayed in Gombe recently, its looks fantastic and was alot of fun. But the majority of Congolese will literally never work nor live there. It's alot like Midtown Manhattan in NYC - which is very, very nice but the majority of NYers do not work or live there.

#DRC: I appreciate this tweet from Mssr Rigaud but its a little confusing - particularly if you do not understand constitutional law in Congo's particular setting.

The big news here is that the @Cour_constRdc has ruled that the controversial referendum law is constitutional.

BUT, they also said issued "interpretative reservations" on several articles in the law that basically say the law is only constitutional if these interpretations are followed by authorities.

Effectively, the DRCC has put clear conditions on how this law can be used to either revise or issue a new constitution - which is significant.

Now, what are those articles in the law? From what I can gather from online sources, its Articles 3, 4, 5, 7, 8, 9, 10, 12, 14, 19, 21, 23 and 43. We do not yet have the ruling to review the conditions. But there is reporting on Art 7 in the law that has these conditions:

1. If the referendum is for a new constitution, atleast 250K petitions must first be collected and certified from Congolese.
2. If a President of #DRC wants to revise or adopt a new constitution because of a "institutional crisis", they first must prove such a crisis exists by setting up a commission of experts who will determine this and also clearly state what can and cannot be changed in the constitution.
3. The court struck vague language in Art 7 and said a referendum must clearly inform Congolese what specific constitutional amendments are being changed.

Basically, Rigaud is right the Court has approved the referendum law - a victory for the ruling coalition in Congo. But they also issued clear conditions that must be met with any referendum - which could be seen as a setback for the ruling coalition in power now in Kinshasa.

If someone finds the written ruling please post it on X. If I find it, I will.

Overall, this was a balanced yet fairly historic decision by the critical court in Congo.
