Adding a little more to this David Einhorn testimony posted by @51bodila, because the timeline behind the clip is wilder than the clip itself.
That is Einhorn in March 2007, telling Congress how private investigators posed as him and his wife to trick phone companies into handing over his call records.
For two years Allied Capital denied it. On its November 2006 earnings call, CEO William Walton insisted "we never received his records." Then a federal grand jury subpoena landed. Two months later, Allied admitted its agent had obtained Einhorn's phone records and Greenlight's too.
Weeks before he testified, Congress had made phone record pretexting a federal crime, up to 10 years in prison. It passed the House in April 2006, stalled in the Senate, and was revived by the HP spying scandal. Signed January 2007. Still the law today. Einhorn's case became Exhibit A for why it was needed: proof this was not one rogue company, but a weapon corporations were using against their critics.
His warning to Congress still holds up. Corporate spying on critics "threatens the freedom of the securities markets that we take for granted."
The kicker: the SEC never acted on the pretexting. It had investigated Einhorn instead. In 2007 the SEC finally found Allied violated securities laws over how it valued its investments, exactly what he said in 2002.

DOJ says Andrew Left was found guilty by jury on June 1, 2026, with sentencing set for Dec. 1, 2026. DOJ/SEC materials describe alleged hidden hedge-fund compensation and short-publisher conflicts.
