An information which may be very disturbing to everyone. A medical distributor of a particular injection which is used in chemotherapy, his wife was suffering from cancer. She was taking treatment in a very renowned hospital. We will not take the name of the hospital. So the dealer requested the hospital authorities, sir I am myself a dealer and to me the injection comes at Rs. 11,000 dealer price. The hospital refused to administer that injection and charged Rs. 1,30,000 for that injection. Can you show any justification for this loot, please? Why this difference? Where does the money go? Court: you are a commercial hospital. You charge for everything. But why should medicine be quoted at 100,200 times? There’s a component of corporate discount. Provided by manufacturers. That’s still under the cover. You can’t justify saying MRP is rightly quoted because I am running a private hospital.

Sr. Adv. Mukul Rohatgi (appears for hospitals): I will answer some questions. Private health industry is here because state health industry is not up to the mark because it’s overstretched. A large part of returns of private hospitals, comes from insurance and govt health schemes. Private paying patients are okay 30% or so. Your lordships asked where does the money go. I will answer.

Court: the question is say Rs. 100 MRP is printed in the medicine. The retailer gets it for 10 or 20. Then why is the price being mentioned as 100? Why is the govt allowing it to continue? And saying they’ll not regulate it because its a not a schedule drug.

Rohatgi: hospital will collapse.

Court: Hospital can survive through other means. Not through this dacoity.

Rohatgi: we cannot trust patient to bring medicine from outside. We can’t trust it. Half of the medicines in the market are anyway spurious. If I reduce drug prices, prices across the board will increase, won’t make any difference. I have to keep all my facilities functioning 24*7. I have to bear costs to keep the infrastructure ready.

Centre: we were already deliberating on it.

Court: is it rocket science? You’re dealing with the lives of people. Don’t take it as commerce. You’re talking only in terms of commerce, economic policy etc.

Centre: we are only balancing.

Court: no. There is no balancing at all. What is the justification for the difference in prices? You are not able to come with an answer. We have asked you 30 times.

Centre: India already has one of the lowest prices in the world. The dichotomy is there which we are addressing from time to time.

Court: suddenly you took decision to bring capping of cancer drugs down to 30%. Why were you silent since so many years? Don’t force us to ask harsh questions.

Court: Ayushman Bharat and other schemes, reimbursement is made by govt. But government won’t reimburse more than 5 lakh rupees. Ultimately it comes on the patient.

Court to Centre: tell us the rationale. You’re saying the answer to this difference (in prices) are to be given by the medical industries. You talk about innovation, tell us in the last 30 years, 5 new molecules developed by the Indian pharma industry. Name five.
