🇺🇸 IS FAUCI IN BIG STATE TROUBLE?! - He could be if states decide to prosecute him after today's plead-a-palooza.

Oops.

Florida Attorney General James Uthmeier posted after the hearing: "Fauci's lack of candor to Congress is unbelievable. My office is launching an investigation into Dr. Fauci. It's past time we get the truth of what happened during COVID."

Sen. Tommy Tuberville, running for governor of Alabama, said the same day that he wants to go after Fauci at the state level. Rep. Anna Paulina Luna called on four specific states to act.

And that's not all!

A coalition of 17 state attorneys general led by South Carolina's Alan Wilson has been investigating Fauci since early 2025, writing to Johnson and Thune requesting cooperation to pursue any state law violations.

WHAT COULD FAUCI BE CHARGED WITH:

The theories floated include state RICO, with Oklahoma state Rep. Justin Humphrey arguing Oklahoma's racketeering statute covers fraud and extortion and alleging those crimes were committed under COVID protocols and harmed Oklahoma victims.

The 17-AG letter cites misleading statements on COVID origins, mismanagement of NIH funding to EcoHealth Alliance, and suppression of debate about vaccine risks. Others have floated fraud, wrongful death, and consumer protection theories.

FAUCI'S DEFENSE:

FEDERAL OFFICER IMMUNITY IS THE BIG ONE - Under Supremacy Clause doctrine going back to In re Neagle in 1890, a state cannot prosecute a federal officer for acts performed within the scope of his federal duties.

Everything Fauci did as NIAID director, from grant decisions to public statements, was inside that scope. This is the wall every one of these theories runs into.

REMOVAL - Under 28 U.S.C. § 1442, a federal officer charged in state court for acts under color of federal office can move the case to federal court. So a state AG who charges him loses the case to a federal judge almost immediately, and that judge applies the immunity doctrine above.

TERRITORIAL JURISDICTION - A state needs conduct or effects within its borders. Fauci worked in Maryland and D.C. Building a Florida or Oklahoma case on nationally broadcast press conferences is an aggressive stretch.

THE CLOCK - Most state felony limitations periods run three to six years, and the conduct is from 2020 through 2022. A lot of it is already time-barred. Homicide theories have no limitations period, but proving a specific death was caused by a specific Fauci decision is not a case anyone wins.

THE CONCLUSION:

While it's fun to imagine states going after Fauci, as you can see by his listed defenses, these probably won't amount to anything.
