Justice Richard Otieno Kwach placed several calls to Chief Justice Evan Murage Gicheru and sent several texts. None was answered. This was odd. Kwach and Gicheru were not only the two most celebrated judges in the country, following their stellar performance at the Ouko Commission of Inquiry, but were also lifelong close mates from the Alliance networks. Their friendship transcended the judicial circles. Kwach therefore thought that if there was something amiss, Gicheru should have had the balls to tell him to his face.
And yet, a tribunal led by Aaron Ringera had just indicted several judges of grand corruption and recommended their removal. Justice Kwach's name topped the list. In the judge's view, it would have been difficult for him, considering the sensitive matters he had handled, including the Ouko Commission that Moi had disbanded midway, to have been a corrupt man under the paranoid Kanu regime. Even more, as judicial "twins", if Kwach was corrupt, Gicheru had to be corrupt too, yet here the latter was, about to preside over the "radical surgery", which suspiciously looked to target mostly judges from outside the Mt Kenya region.
Justices Daniel Aganyanya, Samuel Oguk, Kwach, Roselyn Nambuye, Phillip Waki, Msagha Mbogoli, Moijo Ole Keiuwa, among others, were stunned. In the case of Ole Keiuwa, there was even a back story that people in the new Kibaki regime wanted him in jail so they could grab his expansive wheat farm in Narok. Many of those who challenged this so-called surgery, like Waki, Aganyanya, Nambuye and Ole Keiuwa, were shocked to find just how baseless and petty the accusations against them were. People like Oguk and Kwach opted to leave instead of dragging themselves through stage managed mud. It was a pure witch hunt, but it would soon be clear why the surgery targeted certain independent minded judges from certain regions only.
Because soon, the Anglo Leasing Scandal would erupt, followed by a greedfest in government aptly dubbed "It's Our Turn To Eat" by author Michella Wrong, in conjuction with graft-buster, John Githongo. Kikuyu Entitlement wanted to eat in peace. It was such chaos that these folks even had the audacity to bring into the country foreign mercenaries to protect the looting networks. With Justice Gicheru playing yes man, the judiciary had been sufficiently scared into submission with that radical surgery that never was. Every regime that wants to eat the country dry, doesn't want the inconvenience of a judiciary throwing injunctions around. It's like bedding someone's wife while constantly hearing knocks, forcing you to "remove" each time!
Notice that in this 2003 surgery, Kikuyu Entitlement had just succeeded Kalenjin Incompetence, and the former couldn't countenance the thought that its eating was the one to be stopped after 24 years of the latter's lootfest. Exactly 20 years later in 2023, Kalenjin Incompetence again succeeded Kikuyu Entitlement, in Kenya's despicable power "volleyball". The Ruto regime has woken up to the reality that looting a nation requires a weak judiciary and even weaker scrutiny. Being people of very limited enlightenment and even lesser emotional intelligence, the regime presupposes that they can revisit the 2003 template, beat down the judiciary into a malleable pulp and steal in peace.
The problem for the Kalenjin Incompetence of 2023 is that there is nothing left to steal, short of eating the bones and drinking the blood of the despondent masses. The incompetent and entitled peers who looted before them left nothing but a country in ICU. Even the blood of the patient is now more laced with the dwindling medication. The bigger problem for the Ruto kleptocracy however, is that the country is on edge, waiting for a small trigger, so this is not even the ideal environment in which to pick simultaneous fights with the Judiciary, Mungiki, Raila Odinga, Luos, the people's small incomes, regional leaders, friendly neighbouring countries and..spouses.
