The Erie County Medical Examiner's Office recently ruled Nurul Amin Shah Alam’s death a homicide.
Shah Alam was a mostly blind refugee from Myanmar, who was found dead days after he was dropped off, miles from his home, by federal U.S. Customs and Border Protection agents.
As part of @WGRZ’s ongoing coverage of this story, attorney Barry Covert sat down for an in-studio interview to provide legal analysis.
Over the course of his conversation with WGRZ anchors @ScottLevinTV and @ClaudineWgrz, Barry Covert provided legal analysis and addressed several questions, including:
· Now that an autopsy has ruled Shah Alam's death a homicide, will someone be charged with a crime in this matter?
· What criteria does the medical examiner use to categorize a death as a homicide?
· How does the health commissioner’s definition of a homicide differ from the definition used to determine if criminal charges will be filed?
· Given the facts of the case, could criminal charges such as manslaughter or criminally negligent homicide, be proven beyond a reasonable doubt against the federal agents involved in this matter?
· Given the preponderance of evidence, could federal agents be held liable for Shah Alam’s death in a civil lawsuit?
· What actions do you anticipate the district attorney and state attorney general will take going forward?

The New York State Department of Motor Vehicles recently implemented a new point system, which will result in steeper penalties for traffic violations.
The DMV’s new point system:
1. increases the number of points assessed to a driver’s license for various traffic violations;
2. introduces points as a penalty for traffic violations that previous carried none;
3. lowers the total number of accumulated points that will lead to a license suspension hearing; and
4. extends the period of time that points can be accumulated, leading to the suspension of a driver’s license.
Attorney Barry Covert recently spoke with @97RockBuffalo morning show hosts, @ShreddandRagan, to discuss details on what drivers need to know about the New York State DMV’s new penalties for driving offenses.

Various print and television media outlets recently reported on a judge’s ruling to dismiss all charges, which were filed against a local high school principal, due to an alleged incident involving a student.
Barry Covert, the attorney for the defendant in this matter, filed a motion to have the charges against his client dismissed, successfully arguing that “the facts were facially insufficient to sustain charges” in the matter.
Media reports indicate that after the judge in this case viewed video evidence of the alleged incident, he repeatedly told the principal he did not do anything wrong and acted completely appropriately. All charges in the matter were dismissed with prejudice.

A special prosecutor was recently appointed to review an incident involving the Erie County Sherriff’s Office Chief of Narcotics and members of the Buffalo Police Department.
Attorney @BarryCovertLaw joined @WKBW News' @wkbwMichael Wooten, for an in-studio interview, to provide legal analysis on the case.
Erie County Sherriff’s Office official, Daniel Granville, is accused of being involved in an April 2024 hit-and-run crash. Media reports indicate that the Buffalo Police Department responded to the incident and issued Granville a ticket, which was pleaded down to jaywalking.
Over the course of his conversation with WKBW’s Michael Wooten, Barry Covert provided legal analysis and addressed several questions, including:
• Does the appointment of an outside prosecutor suggest criminal charges are being considered in this matter?
• What kind of charges could be brought in this incident and who could they be brought against?
• How difficult is it for a prosecutor or investigator to pick up a case like this, almost a year after the incident happened?
• How unusual are the circumstances of this matter?
• Is leaving the scene of an accident considered to be a serious crime?

• Does the President have the constitutional authority to abolish the Department of Education by executive order?
• If Congress has voted to allocate money to the Department of Education, is the President obligated to spend that money for its intended use?
• Does the President have the ability to change the management and organizational structure of the Department of Education?
• Has the Supreme Court ever ruled on issues related to this matter in the past?
• Can states file lawsuits against attempted executive orders by the President?
• How quickly will legal challenges to executive orders move through the courts?
