@OttoHammerOne@tbierly@NatetheLawyer Very fair points. What causes her to circle around the car? She initially points the gun, he shows his hands, but then he takes a step towards her. I think that’s when her thought process went to “he might be willing to try and get the gun.”

That changes the perception of threat - as it would with a police officer, for example. If the gun stopped him? Now you can make a much better case she didn’t have reason to feel threatened in the moment
@TCP31943702@NatetheLawyer Could be - if she (or he) has prior history of aggressive behavior, that will play a factor too. Regardless of the court’s outcome, it’s not a situation where someone deserved to die.

All she knows in the moment is a guy repeatedly getting close enough to make a quick move and control her firearm. Drugs? Crazy? Reasonable doubt

@jonrhewitt@NatetheLawyer There’s a lot of gray, no doubt. Who’s the aggressor here? She gets out of the car with a gun, he approaches. She doesn’t raise it until he’s 8 feet away. If she fired at that point, I would say it’s tougher to perceive as deadly from her POV.
