@BirdBath_Beyond@tbierly@NatetheLawyer It's all going to come down to stand your ground not requiring a duty to retreat an imminent threat, or there was no imminent threat and it required de-escalation on her part. I believe it to be the latter. It's been a pleasant back-and-forth with you.
@stevewerier Wouldn't it make more sense for Team B to make a deal and get their own 2nd back to do the offer sheet themselves? St. Louis did that for the Broberg offer sheet. https://t.co/CaAXP2tvU5
@BirdBath_Beyond@tbierly@NatetheLawyer I would absolutely agree that following a person that is armed is a horrible decision, but you state an important point here. He was raising his hands in the air at times, which would objectively not be a threat. He wasn't charging or lunging, and that's going to be important.
@Oatsofwaker@skettles01@DallasStarsDDH Me too, buddy. Me too. The number of times he hangs out in the neutral zone when the play breaks down is atrocious. I know you're not very fast, but at least try and get back into the play!
@BirdBath_Beyond@tbierly@NatetheLawyer What does "advancing" mean, in your opinion? Walking toward someone doesn't automatically create an objectively reasonable threat. There has to be imminency, and you stated yourself that there wasn't. She may have an affirmative defense, but not a rebuttable presumption of fear.
@BirdBath_Beyond@tbierly@NatetheLawyer That's speculation that will not be allowed in a trial. She didn't know he was a veteran, crazy, or on drugs, and those things don't automatically make him a threat if they're true and discovered after the fact. Self-defense is an affirmative defense, not reasonable doubt.
@BirdBath_Beyond@tbierly@NatetheLawyer She will use her subjective experience as a defense, but your statement that you don't believe he was going to harm her is the objective standard they will use to prove it. Unless you believe you're unreasonable believing he wasn't going to harm her.
@seckzey@DallasStarsDDH@Kevin062411 And the whole time I've only been arguing about the cap space mechanics being wrong in his post, only working if you're talking about playoff lineups. I apologize for the misunderstanding.
@seckzey@DallasStarsDDH@Kevin062411 You are correct, but that's not what I was saying. I was targeting the fact the poster says $14+ million in cap space, and arguing they send players down to get there. That's not how it works in the regular season. There needs to be a player to send down, which they don't have.
@seckzey@DallasStarsDDH@Kevin062411 I think I see the disconnect. Regular season rosters don't work this way because the cap space for a game lineup only matters in the playoffs. Suggesting $14+m in cap space for the regular season is not how it works. There is no one to send down.
@seckzey@DallasStarsDDH@Kevin062411 What are you missing here? This is the bare minimum roster they can carry. There is no one to send down. This is for 18 skaters, 2 goalies, and Capobianco that requires waivers to be sent down. The post was wrong.
@seckzey@DallasStarsDDH@Kevin062411 Post claim: $14,239,667
Capobianco: $875,000
Hyry: $900,000
Robertson: $??????
Cap space: $12,464,667
That's for 21/23 roster, requiring 20 for game lineups and Capo that requires waivers. Then add in at least $850,000 for the extra forward they will absolutely carry.
@seckzey@DallasStarsDDH@Kevin062411 For the playoffs, only your game lineup has to be cap compliant. During the regular season, it's your full 23-man roster. The graphic is correct for a playoff lineup, but not for a regular season roster.
@seckzey@DallasStarsDDH@Kevin062411 So add Capobianco and at least another league minimum contract for the other empty forward position... how much cap space is left? Around the amount that Puckpedia is estimating. The post was wrong when written, and is still wrong now.
@seckzey@DallasStarsDDH@Kevin062411 Capobianco would require waivers, so go ahead and add his AAV into the equation. They will carry 22-23 this season, not 20. More moves are coming.
@DallasStarsDDH@seckzey@Kevin062411 I need you to hear this... they won't run a 20-man roster all year to accommodate Robertson. More moves are coming. Those three roster spots are how you keep players in reserve without losing them to waivers or not having enough time for a call-up.
