The Railways has issued an advisory directing that all RTI replies to citizens must be cleared by the Zonal Railway General Managers or Divisional Railway Managers.

A PIO is to act independently, as per the RTI Act. This policy to officially seek “clearance” is not envisaged by the Act. Of course, in more important Ministries, it’s a practice for PIOs to seek oral clearances, if not on paper. But they are not bound, as this circular makes them.

This will have a chilling effect on other PIOs who will further restrict sharing information openly. The appeal mechanism will take 2-3 years to exhaust. High chances that the CIC will not order any information disclosure. It will take another 3-5 years for a court to adjudicate, if the RTI applicant has the wherewithal to approach it.

Effectively, the RTI Act is turned redundant.
