@JudgeMinor Educational institutions don't have time to just teach good writing. You have to develop a level of confidence in writing...hard to do straight out of law school. Writing is also somewhat personal. It's hard to write in someone else's style. I suspect even Alito evolved.

If I were 2 bourbons in, I would say that non-lawyers should refrain from commenting on appellate opinions, because they are not competent to do so. At 3 bourbons, I am more comfortable just frankly saying that if you aren't an appellate attorney, you should just shut up.
