What I don’t think ppl understand is how broad Massachusetts’ insanity-defense rules really are.
A defendant lacks criminal responsibility if, due to mental disease or defect, they lack the substantial capacity EITHER:
-to appreciate the criminality or wrongfulness of the conduct OR
-to conform their conduct to the requirements of the law (Commonwealth vs. McHoul).
Not both/and, either/or.
And on top of that, the defense does not have to convince a jury beyond a reasonable doubt that their client was/is mentally diseased & therefore lacks criminal responsibility.
The prosecution bears the burden of proving beyond a reasonable doubt that the defendant was NOT mentally diseased/defective enough to lack substantial capacity.
That is ludicrous to me.
If Lindsay Clancy had murdered her 3 kids in Alabama she would be rotting in a cell until she died or was put to death.
But in Massachusetts, under their laws, she is not criminally responsible.
How is this just?

He didn't debte a criminal case.
He defended the position that there was overwhelming evidence that Tyler Robinson shot and killed Charlie Kirk from the Lohsee building with a .30-06 rifle that was found in the nearby woods.
This was clearly established at the beginning of the debate and both parties agreed.
Knowing the 7 charges is irrelevant to this claim.
Why is everyone resorting to dishonesty about the terms of the debate?
5 lbs in a month is great!! I’ve been at the same weight for about 3 months…. I gave up a little until about 2 weeks ago😅
OMAD was definitely challenging, 50 of those 60 lbs was what I gained during pregnancy & I was able to get it all off +10 lbs OMADing & walking at least 5,000 steps a day (I couldn’t get 10,000 in with how badly labor messed up my pelvis). Intermittent fasting has worked well for me in the past, too!
I’ve still got ~30 lbs to go but I’ll get there. Trying to get it off before we have another baby!
I have a friend with fibromyalgia, it’s not fun at all!!
