Assistant DPP Thomas Jatiko’s facial expression as the state’s key witness said he was stupid, is just comedy gold.
They were cross examining him on whether there’s a primary source for the electronic evidence (audio/video recordings) he presented in court.
He said there wasn’t; the same having been deleted.
You might recall that recently, in the Katanga case, Justice Rosette Kania said court couldn’t accept any electronic evidence whose primary source couldn’t be traced. Not even with clear meta-data.
The state essentially stopped a defense witness testifying on images he took at the Katanga residence. It was a controversial issue.
This Dr Besigye/Lutale/ Oola case is now grappling with the same issue. The witness has testified on evidence whose primary source he acknowledged he didn’t have.
Defense attorney: You just said you deleted.
