That’s a distinction that may make a difference in the jury’s view whether he had a reasonable fear of death. But as the instigator he gets no benefit of any doubt from me.

No honest jury will find that reasonable.

Getting pushed by an unarmed kid you picked a fight with doesn’t count.

Like if you were trying to flee and the assault continued, or the assault is so grossly disproportional that it is no longer an expected response to the offense. I doubt Chud can prove that; however, as I said, idk the facts in that case.
