A Case Brief on the recent Court of Appeal's ruling (CoA Civil Appeals No. E029 of 2022) on Abortion in Kenya.
The Court of Appeal did overturn the 2022 High Court ruling in PAK & Salim Mohammed v AG. The court held that abortion is only lawful within the narrow limits of Art. 26(4), reinstated criminal charges, and ruled that rights claims (dignity, privacy, health) must be argued during trial not used to stop prosecution early.
