The parents in the Birthright Citizenship Case may be here, but they have foreign documents and, usually, foreign domiciles. So they have dual allegiances and dual domiciles. The Constitution says NOTHING about this duality. SCOTUS needs a way to punt.

Someone has misread this post. Let me restate a line. SCOTUS should be able to punt by ruling that the text of the Constitution does NOT address a specific issue. SCOTUS should be able to say that SCOTUS is refusing to redefine the text with meanings that previously never existed
