Gazettement of the 𝐓𝐇𝐄 𝐄𝐍𝐄𝐑𝐆𝐘 (𝐄𝐋𝐄𝐂𝐓𝐑𝐈𝐂𝐈𝐓𝐘 𝐌𝐀𝐑𝐊𝐄𝐓, 𝐁𝐔𝐋𝐊 𝐒𝐔𝐏𝐏𝐋𝐘 𝐀𝐍𝐃 𝐎𝐏𝐄𝐍 𝐀𝐂𝐂𝐄𝐒𝐒) 𝐑𝐄𝐆𝐔𝐋𝐀𝐓𝐈𝐎𝐍𝐒, 𝟐𝟎𝟐𝟔

What just changed? The market is now open by regulation to 𝐃𝐢𝐫𝐞𝐜𝐭 𝐒𝐮𝐩𝐩𝐥𝐲 through 𝐖𝐡𝐞𝐞𝐥𝐢𝐧𝐠, 𝐁𝐮𝐥𝐤 𝐒𝐮𝐩𝐩𝐥𝐲 and a future 𝐖𝐡𝐨𝐥𝐞𝐬𝐚𝐥𝐞 𝐌𝐚𝐫𝐤𝐞𝐭.
Here's what the new rules allow: -
🪶A real electricity marketplace is now open - generators, retailers, importers, exporters, and big consumers can all buy and sell power from each other, not just through the utility.
🪶You can choose your electricity retailer - like choosing a mobile network. If you don't like your current supplier, you can switch (just tell the old one in writing first).
🪶New retail companies can enter the market - Utility is not the only company allowed to sell you electricity.
🪶Big power users can buy electricity directly from power plants - factories, malls, and large institutions can skip the middleman and negotiate straight with generators.
🪶But only if you're big enough - you need a load of at least 1 MVA (distribution) or 10 MVA (transmission). This is industrial scale, not your home.
🪶Anyone (qualifying) can rent the power lines - called "open access." If you generate power in one place and want to sell it in another, you can pay KETRACO or KPLC to wheel it through their wires.
🪶Three ways to trade power - bilateral deals (private contracts), spot market (buy now, deliver now), or forward contracts (lock in a future price).
🪶Four types of wire-rental contracts - long-term (5+ years), medium-term (1-5 years), short-term (up to 1 year), or day-ahead/emergency.
🪶A System Operator runs the show - registers everyone, runs an online trading portal, matches buyers with sellers, handles settlements, and keeps the grid stable.
🪶Cross-border trade is formalized - Kenya can import and export electricity through the Eastern Africa Power Pool.
🪶Clear timelines for approvals - bulk supply applications get a response in 30 days; the regulator decides within 60 days; open access decisions within 45 days after technical review.
🪶Disputes have a clear path - complain to the Energy and Petroleum Regulatory Authority first; if unhappy, appeal to the Energy and Petroleum Tribunal.
🪶Lying on applications is a crime - false information triggers penalties under sections 210 and 221 of the Energy Act.
🪶Easing in gently - during a "transitional phase," joining the market is voluntary, but all trades must be disclosed to the System Operator.
Bottom line: 📍 More competition, 📍 more choice, 📍 more players.
