The first MPIA report is out.
This sentence on treaty interpretation marks a sea-change in WTO jurisprudence.
Had the Appellate Body adopted this approach 22 years ago, it would still exist today.
A few observations on the report:
Excellent- 16 ratifications done, 11 to go. 🇪🇺 🇨🇦partnership more important than ever. #CETA provides a sound basis for + diversified, resilient suppy chains, raw material partnerships and coordinating policies on climate change. So who is next to ratify?
Don't know enough of the issue to strike this up as an EU or UK 'win', suffice to say it is good when potential trade issues that arise around regulation can be resolved.

What to make of the outcome of MC12?
There are two camps: many celebrate the agreements as historic; others see the substance as meagre and mostly an exercise in self-preservation.
There is truth in both views but they also miss an important dimension of what was achieved. A🧵

WTO ministers reach historic agreements on response to food insecurity, @wfp food purchases exemption, WTO response to the pandemic, #TRIPS, #ecommerce moratorium, and #fisheriessubsidies. More info coming soon. #MC12
The agreements in MC12 are good news indeed. The outcomes are not perfect, but what is remarkable is the spirit of accommodation and compromise they reflect. The strong message to sceptics is: reports of the demise of multilateralism are greatly exaggerated.
Antônio Cançado Trindade, Latin America's Judge Hercules, has passed away.
I have no words to describe what his work meant to me and many others.
Descansa en paz, Mr. International Law for Humankind.
The ILC adopts 23 draft conclusions on peremptory norms of general international law (jus cogens)! Congratulations Dire Tladi for his leadership in guiding the Commission on this important and fascinating subject #internationallaw#internationallawcommission
“It honours me deeply that renowned international legal personalities, judges, professors, members of the national groups of the PCA, and esteemed colleagues support my candidacy to the International Court of Justice for the 2024-2033 period” ⚖️🇺🇳 Professor Marcelo Kohen.
Panel report was circulated through the DSU Article 25 notice of appeal. First time this has happened.
If Article 25 appeals prove a viable alternative to Appellate Body, could put pressure on US to engage on unblocking the Appellate Body and getting WTO DS working again.
@EU_Commission It is a noteworthy signal of principled #trade. The proposal itself reconfirms that @Trade_EU policy—like its wider external action—is guided by the principles that inspired the #EU's creation, which it also seeks to advance in the wider world. 🇪🇺🌍
@EU_Commission As the press release reads, '[t]he European Commission has proposed today to suspend for one year import duties on all Ukrainian exports to the European Union [and] all EU anti-dumping and safeguard measures in place on Ukrainian steel exports.'
Insightful report on #subsidy practices below. 👇🏾
In light of the hundreds of billions of dollars of public aid mentioned in the report: is it time to rethink the value of #tariff concessions and other #marketaccess commitments?
The growing use of distortive subsidies alters trade and investment flows & undercuts public support for open trade. A new joint report from the @IMFNews@WorldBank@OECD and @WTO underlines the potential benefits of closer int'l cooperation on the issue. https://t.co/LaZsZRgzgF
I remember my first time reading 'complexity takes' on #trade and #investment law a few years ago...
...and like those takes were must-reads there, the article discussed below on 'complexity-minded' #antitrust will leave you with more pertinent questions than answers.👇🏾
New dates set: WTO members agreed, during today's General Council meeting, to reconvene the 12th Ministerial Conference in Geneva during the week of 13 June.
