This sentence on treaty interpretation marks a sea-change in WTO jurisprudence.

Had the Appellate Body adopted this approach 22 years ago, it would still exist today.

What to make of the outcome of MC12?

There are two camps: many celebrate the agreements as historic; others see the substance as meagre and mostly an exercise in self-preservation.

The agreements in MC12 are good news indeed. The outcomes are not perfect, but what is remarkable is the spirit of accommodation and compromise they reflect. The strong message to sceptics is: reports of the demise of multilateralism are greatly exaggerated.
