I was an investor in Spirit. At the time, during the trial, the judge mentioned that he believed the transaction could be approved with some concessions from Spirit. All concessions were given but the final verdict was anyway aginst the merger...if you read the verdict, it is very obvious there were external forces at play. It was already known at the time that Spirit would go bankrupt without the approval of the merger.
@elonmusk The quick math is that for every 2 NEW people in California, they hired a new government employee (1 of those 2) with that level of coverage you would expect amazing government responsiveness
My understanding is that the total enterprise valuation was $45B versus the original $44B acquisition (the equity value is $33B). That would mean the valuation is up (2%) not down 25%. Valuation are usually made at the total enterprise value, as people can easily distribute cash by leveraging.
@BillAckman@NeriOxman Most of the paragraphs they are referring to are just footnotes...and most of those footnotes are definitions. Definitions are normally copied as they are definitions.
