In 2011 the Equality Court (Judge Colin Lamont) found that Julius Malema singing the song (commonly called “Dubul’ ibhunu” / “Shoot the Boer” or “Kill the Boer”) was hate speech. The court said the words could reasonably be understood as intending to be hurtful, to incite harm, and to promote hatred against white Afrikaans-speaking people, including farmers. Malema was interdicted from singing it.
That earlier finding did not end the issue. AfriForum later sued Malema and the EFF over later public performances of the song (including after the 2020 Senekal farm-murder case). In 2022 the Equality Court (Judge Edwin Molahlehi) dismissed that complaint. It held AfriForum had not shown the lyrics demonstrated a clear intention to harm or incite harm; the song was treated as historical political/struggle speech that should not be read literally. AfriForum was ordered to pay costs.
The Supreme Court of Appeal upheld that 2022 ruling in 2024. It said a reasonably well-informed listener would understand Malema was using a historic protest song as provocative political speech, not a literal call to shoot farmers.
In March 2025 the Constitutional Court refused AfriForum leave to appeal, stating the application had no reasonable prospects of success. That left the 2022/2024 findings as the last word in that litigation.
So: an earlier Equality Court judgment did classify the song as hate speech and banned Malema from singing it; later Equality Court, SCA, and Constitutional Court decisions on subsequent performances found it was not hate speech under the Equality Act and was protected political expression. Separate later hate-speech findings against Malema have concerned other remarks, not this song.

This isn’t abstract grievance. It’s generational. Afrikaner families have lived on this soil since the 1600's, longer than most Americans have lived in America. They speak an African language born on African soil. Their culture produced writers, scientists, engineers, and farmers who turned arid land into the breadbasket of a continent. Now the state tells them their very identity is the problem. Land expropriation without compensation is sold as “justice,” but everyone knows which minority’s farms are targeted first. Race-based B-BBEE laws, employment equity quotas, and university admissions that openly discriminate against White students don’t “level the playing field,” they slam the door on an entire generation of South African kids because of the color of their skin and the surnames on their birth certificates.
These are not “settlers” plotting to return to Europe. Most have nowhere else to go and never wanted to leave. They stayed through farm attacks that include torture, rape, and mutilation the media downplays as “robberies.” They stayed while politicians openly called for their land and their removal from the economy. They stayed while their government imported Cuban doctors, Chinese infrastructure workers, and Zimbabwean cadres while telling qualified local engineers and teachers they’re “over-represented.”
So when some of them finally say “enough” and apply for refugee status in America, Australia, or Europe, don’t you dare call it betrayal. Don’t you dare tell them they’re “exaggerating” or “racist” for wanting their children to grow up without racial quotas hanging over their heads like a death sentence.

A WARNING TO THE WEST: @NYYRC Delegation Arrives in South Africa for Extended Visit and Strategic Engagement
Pretoria, South Africa – A delegation from the New York Young Republican Club (NYYRC), led by its President, @StefanoLforte, has arrived in South Africa for an extended visit of more than a week at the invitation of the think tank and advocacy group, @LexLibertasOnX.
The NYYRC has expressed concern that South Africa’s decline since 1994 is a warning to all Western nations as to what is in store for the White population once they become a political minority — the end of civil rights, redistributive injustice, and a perpetual anarcho-tyranny.
The American and Afrikaner people share a tradition of self-determination; the NYYRC is here to study the perils of race-socialism and the fallacy of “the end of history.”
