Purpose: To address complaints regarding how Ugandan citizens, particularly passport applicants, are treated when proving their citizenship.
𝐂𝐢𝐭𝐢𝐳𝐞𝐧𝐬𝐡𝐢𝐩 𝐓𝐲𝐩𝐞𝐬 𝐚𝐬 𝐃𝐞𝐟𝐢𝐧𝐞𝐝 𝐢𝐧 𝐭𝐡𝐞 𝐂𝐨𝐧𝐬𝐭𝐢𝐭𝐮𝐭𝐢𝐨𝐧
𝐶𝑖𝑡𝑖𝑧𝑒𝑛𝑠ℎ𝑖𝑝 𝑏𝑦 𝐵𝑖𝑟𝑡ℎ: Automatically acquired by Ugandans born in Uganda.
𝐶𝑖𝑡𝑖𝑧𝑒𝑛𝑠ℎ𝑖𝑝 𝑏𝑦 𝑅𝑒𝑔𝑖𝑠𝑡𝑟𝑎𝑡𝑖𝑜𝑛: Acquired through a legal process for persons born abroad or foreigners.
𝐶𝑖𝑡𝑖𝑧𝑒𝑛𝑠ℎ𝑖𝑝 𝑏𝑦 𝑁𝑎𝑡𝑢𝑟𝑎𝑙𝑖𝑧𝑎𝑡𝑖𝑜𝑛: Granted to non-citizens who meet certain criteria.
𝐈𝐬𝐬𝐮𝐞 𝐈𝐝𝐞𝐧𝐭𝐢𝐟𝐢𝐞𝐝
𝐏𝐫𝐨𝐛𝐥𝐞𝐦: The problem is not the law but how it's administratively applied in proving citizenship, particularly when citizens apply for passports or other identity documents.
𝐃𝐢𝐫𝐞𝐜𝐭𝐢𝐯𝐞𝐬
𝐑𝐢𝐠𝐡𝐭 𝐭𝐨 𝐈𝐝𝐞𝐧𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐢𝐨𝐧 𝐃𝐨𝐜𝐮𝐦𝐞𝐧𝐭𝐬:
Every Ugandan citizen has the right to a passport or travel document, and to enter, leave, and return to Uganda.
𝐀𝐩𝐩𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧 𝐟𝐨𝐫 𝐏𝐚𝐬𝐬𝐩𝐨𝐫𝐭𝐬
Upon receiving a passport application, officials should refer to the Citizenship and Immigration Control Act, specifically Section 40, which only requires applicants to present their National Identification Number (NIN) and meet any other published legal requirements.
𝐋𝐚𝐰-𝐁𝐚𝐬𝐞𝐝 𝐀𝐝𝐦𝐢𝐧𝐢𝐬𝐭𝐫𝐚𝐭𝐢𝐯𝐞 𝐏𝐫𝐨𝐜𝐞𝐬𝐬
All administrative processes related to proving citizenship must align with the 1995 Constitution and relevant laws.
No extra requirements not outlined by the law should be imposed on applicants.
𝐏𝐫𝐞𝐬𝐮𝐦𝐩𝐭𝐢𝐨𝐧 𝐨𝐟 𝐂𝐢𝐭𝐢𝐳𝐞𝐧𝐬𝐡𝐢𝐩
Immigration officials must assume that an applicant is a Ugandan citizen by birth unless reliable evidence suggests otherwise. Citizenship by birth is inherent and not granted by immigration officers.
𝐑𝐞𝐬𝐩𝐨𝐧𝐬𝐢𝐛𝐢𝐥𝐢𝐭𝐲 𝐨𝐟 𝐈𝐦𝐦𝐢𝐠𝐫𝐚𝐭𝐢𝐨𝐧 𝐎𝐟𝐟𝐢𝐜𝐞𝐫𝐬
Immigration officers must prove the inaccuracy of an applicant’s citizenship claim with solid evidence and send such evidence to the National Identification and Registration Authority (NIRA) for further investigation.
𝐇𝐚𝐧𝐝𝐥𝐢𝐧𝐠 𝐨𝐟 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐈𝐝𝐞𝐧𝐭𝐢𝐭𝐲 𝐂𝐚𝐫𝐝𝐬
Immigration officials should not confiscate or cancel National ID cards without following due legal process. If any discrepancies are found in an applicant’s records, NIRA should be consulted for corrections, not the Directorate of Citizenship and Immigration Control.
𝐂𝐢𝐭𝐢𝐳𝐞𝐧𝐬𝐡𝐢𝐩 𝐈𝐧𝐯𝐞𝐬𝐭𝐢𝐠𝐚𝐭𝐢𝐨𝐧 𝐏𝐫𝐨𝐜𝐞𝐬𝐬
Immigration officers are not responsible for investigating citizenship by birth. If there is a question about the truth of an applicant’s claim, the matter should be referred to NIRA following the procedures set out in the Registration of Persons Act.

Required documents for registration with NIRA: Birth certificate, voter’s card, and driving permit (as outlined by law).
