A former U.S. Solicitor General just put out a paper arguing that the ROAD to Housing Act is "constitutionally flawed thrice over."

It's not an easy read, full of legalese, but boils down to three key arguments:

1) It violates the Constitution's "takings" clause by forcing investors to sell most houses they build/buy after 7 years.

2) It violates the equal protections enshrined in the Fifth Amendment, discriminating against a particular group of people (those owning 350+ homes).

3) It's federal overreach into issues the Constitution grants to local control.
