DPP secures 10-year sentence for Taveta telecom vandal
The Director of Public Prosecutions (DPP) has secured a 10-year prison sentence for a man convicted of vandalising telecommunications infrastructure worth more than Ksh.5.1 million in Taveta, Taita Taveta County.
Jacob Mutungi Matolo was sentenced by Senior Principal Magistrate Cecilia Kithinji after the prosecution proved beyond reasonable doubt that he tampered with and vandalised a telecommunications plant belonging to American Tower Corporation.
Matolo faced two counts of tampering with a telecommunications plant contrary to Section 32(c) of the Kenya Information and Communication Act, Cap. 411A, and stealing contrary to Section 268 as read with Section 275 of the Penal Code. He also faced an alternative charge of handling stolen property contrary to Section 322(1)(2) of the Penal Code.
The court heard that between April and July 2025, at Kidongu Communication Tower in Taita Taveta Sub-County, Matolo, acting with others, forcibly accessed the telecommunications facility and unlawfully vandalised and severed equipment valued at Ksh.5,118,546, with the intention of stealing it.
Investigations subsequently led to the recovery of the vandalised items from Matolo. The property was positively identified by officers from American Tower Corporation.
Prosecution, led by Principal Prosecution Counsel Charles Mogaka PPC presented four witnesses and produced documentary and physical exhibits in support of the case.
Hon. Kithinji found that the evidence presented by the prosecution, including witness testimony and exhibits, sufficiently established the accused's involvement in the offences and warranted his conviction.
Matolo was consequently sentenced to 10 years' imprisonment and the court granted him 14 days within which to appeal.

BS 5950 and 8110 are less economical but that doesn’t mean they are unsafe. If someone is not willing to transition, you cannot force them.
In a country where clients barely give one supervision contracts , one has to be conservative.
Lastly , Kenya is still adopting the Eurocodes and we barely have country specific Annex data like South Africa.
The framework is there but more needs to be done.

I recently learned that BS 8110, BS 5950 among other structural design standards remain widely referenced in structural design in several projects. For engineers who still use these obsolete standards, I am curios to learn, which factors influence this decision?

I was recently contacted to review a design for a project in one of the leafy suburbs of Nairobi. The structural designs were dated August 2026 but referenced standards that were withdrawn in 2010.
Engineering standards have evolved over time stemming from years of research and innovative sustainable construction materials and practices. The conversation is currently gravitating to generation 2 Structural Eurocodes yet most of us have not embraced the first generation.
Adoption of Structural Eurocodes offer an international approach to European harmonized structural design with a keen focus to domestication through Nationally Determined Parameters published as National Annexes to the Structural Eurocodes.
