"We might not have another tax amnesty" - KRA Chief Manager for Policy, Josephine Mugure, says.

She argues that recurrent amnesties are creating a perverse outcome such that compliant taxpayers feel disenfranchised as non-compliant ones are almost assured there will always be yet another amnesty to fall back on.

Musings:

· In my view, there's a valid point being made here
· However, in the absence of amnesties, tax structures typically have an in-built mechanism for granting waivers, on a case by case basis, based on an agreed upon framework
· Finance Bill 2027 should consider reviving Sec37 of the Tax Procedures Act as was designed in the pre-Finance Act 2023 repeal
· What will be needed are guard rails to ensure the risk of abuse, as was the case & really what necessitated the Finance Act 2023 repeal, is mitigated
